HomeMy WebLinkAbout18440 - RESOLUTIONS - 7/20/1994 RESOLUTION NO. 18440 ACCEPTING A 30-DAY FREE TRIAL PERIOD OFFER OF AMERICAN TURF FOR TWO BUNTON TRIPLEX GREENSMOWERS; PROVIDING FOR EVALUATION, ACCEPTANCE, OR RESECTION OF THE BID TO PURCHASE SAID EQUIPMENT AT THE CONCLUSION OF SAID TRIAL PERIOD; AND PROVIDING FOR AN ' ALTERNATE AWARD OF PURCHASE FROM THE SECOND LOWEST BIDDER, PACIFIC EQUIPMENT & IRRIGATION. WHEREAS, prior to final award of Bid 94-26 (Partial) , the City of Palm Springs and American Turf agreed to a 30-day free trial period for two Bunton Triplex Greensmowers, Model BG61L, inasmuch as the equipment has no prior performance record in desert climates . WHEREAS, the City, in its sole judgment, will determine whether the equipment has performed satisfactorily, and the City' s evaluation shall be final . WHEREAS, if the City determines that the equipment cannot perform satisfactorily in desert climates, and meet the City' s needs, time being of the essence, an alternate authorization for awarding purchase of equipment is desired. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs, as follows : Section 1 : That the offer of American Turf for a 30-day free trial period of two Bunton Triplex Greensmowers, Model BG61L, is hereby accepted; ' said period to commence upon delivery of said equipment . Section 2 : That during the 30-day free trial period, the City will evaluate the performance of the equipment, and at the conclusion of the trial period, shall in its sole judgement determine whether to accept or reject the performance of the equipment as satisfactory to the City' s needs, and within 24 hours thereof, the City Manager, or his designee, shall notify the provider by either a) written rejection of the bid to purchase the equipment; or b) issuance of a Purchase Order in favor of American Turf, for the amount of $23 , 511 . 05 . Section 3 : That upon the rejection of the bid to purchase said equipment from American Turf, the City Manager, as an alternate, shall authorize the purchase of said equipment from the second lowest bidder, Pacific Equipment & Irrigation of Palm Desert, for $30, 079 .49 .
