OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, APPROVING THE FORMATION OF AN UNDERGROUND
UTILITY DISTRICT ON EAST PALM CANYON DRIVE (FARRELL DRIVE
TO ESCOBA DRIVE), ESCOBA DRIVE (E. PALM CANYON DRIVE TO EL
CIELO ROAD), EL CIELO ROAD (ESCOBA DRIVE TO RAMON ROAD)
AND SONORA ROAD (EL CIELO ROAD TO SCE SUBSTATION), UNDER
RULE 20A OF SOUTHERN CALIFORNIA EDISON CO. (SCE) AND
CALIFORNIA PUBLIC UTILITIES COMMISSION (PUC) GUIDELINES.

WHEREAS, Ordinance No.1316 establishes a procedure for the creation of underground utility
districts and requires as the initial step in such procedure the holding of a public hearing to
ascertain whether public necessity, health, safety, or welfare requires the removal of poles,
overhead wires and associated overhead structures and the underground installation of wires and
facilities for supplying electric, communication, or similar or associated service in any such
district; and
WHEREAS, it has been recommended that such an underground utility district, hereinafter
called District, be formed on East Palm Canyon Drive (Farrell Drive to Escoba Drive) Escoba
Drive (E. Palm Canyon Drive to El Cielo Road), El Cielo Road (Escoba Drive to Ramon Road)
' and Sonora Road (El Cielo Road to SCE Substation), under Rule 20A of Southern California
Edison Co. (SCE) and California Public Utilities Commission (PUC) guidelines.
WHEREAS, Resolution of Necessity No. 18390 was approved by City Council on May 18,
1994, selling the date of Public Hearing which was held by the Council of the City of Palm
Springs on July 6, 1994, at the hour of 7:30 P.M. in the Council Chambers of the City Hall,
Palm Springs, California, to ascertain whether the public necessity, health, safety or welfare
requires the removal of poles, overhead wires and associated overhead structures and the
underground installation of wires and facilities for supplying electric, communication, or similar
associated service in the District hereinabove described.
WHEREAS, The City Clerk notified all affected property owners as shown on the last equalized
assessment roll and utilities concerned of the time and place of such hearing by mailing a copy
of the Resolution of Necessity to such property owners and utilities concerned at least ten (10)
days prior to the dale thereof. Also that the Resolution of Necessity and Meeting Notice was
published in the Desert Sun newspaper on June 15, and 20, 1994.
WHEREAS, at such hearing all persons interested were given an opportunity to be heard.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs,
California as follows:
Section 1. That the City Council of the City of Palm Springs, California hereby finds
and determines that the public necessity, health, safety and welfare require the
removal of poles, overhead wires and associated structures, and the underground
installation of wires and facilities for supplying electric communication, or similar
or associated services as shown upon that certain map entitled Rule 20A project
on East Palm Canyon Drive (Deepwell Road to Escoba Drive), Escoba Drive (E.
Palm Canyon Drive to El Cielo Road), El Cielo Road (Escoba Drive to Ramon 3 1

Road) and Sonora Road (El Cielo Road to SCE substation) dated May 18, 1994,
which is on file in the office of the City Clerk of the City of Palm Springs, '
California. City Project No. 93-48.
Section 2. That the City Council finds:
a. That such undergrounding will avoid or eliminate an unusually heavy
concentration of overhead electric facilities;
b. That the street, or road right-of-way is extensively used by the general
public and carries a heavy volume of pedestrian or vehicular traffic;
C. That the street or road right-of-way passes through a public recreation
area and an area of unusual scenic interest to the general public.
Section 3. That all poles, overhead wires and associated overhead structures shall be
removed, underground installation made and property owner ire-connections
completed not later than December 31, 1997.
Section 4. That the City Council of the City of Palm Springs, California does hereby
authorize the Southern California Edison Company to proceed with the work
ADOPTED this 6th day of duly, 1994 '
