OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, UPHOLDING THE PLANNING
COMMISSION DENIAL OF REVISED PLANS FOR CASE
5 . 0631-PD-227/TPM 27975 TO ALLOW A COMMUNITY
SHOPPING CENTER ON THE SOUTHEAST CORNER OF ,
SUNRISE WAY AND VISTA CHINO, C-S-C ZONE,
SECTION 12 .
WHEREAS, Palm S•,rings Center Limited ( "Applicant" ) has filed
revised plans for Case 5 . 0631-PD-2.27/TPM 27975 for a Planned
Development District/Tentative Parcel Map to allow a Community
Shopping Center at the Southeast corner of Sunr-ise Way and Vista
Chino; and
WHEREAS, the Planning Commission considered the revised plans at
its regular meeting on June 8, 1994; and
WHEREAS, the Planning Commission denied the revised plans on the
basis that the plans present serious concerns regarding site
Oesign, on-site circulation and off-site noise; and
74HEREAS, the City council considered the revised plans at its
-.egular meeting on July 6, 1-994; and
WHEREAS, this application was assessed with respect to the
California Environmental Quality Act with the determination that
the original environmental assessment of the Planned Development
District/Tentative Parcel Map applications is adequate: and no
further environmental review is necessary; and '
WHEREAS, the City Council has carefully reviewed and considered all
of the evidence presented in connection with the hearing on the
project, included but not.-t limited to the staff report and all
written and oral testimony presented at the hearing.
THE CITY COUNCIL HEREBY FINDS AS FOLLOWS:
Section 1: Pursua.nt. to CEQA, the City Council finds as
follows :
The project was previously assessed with respect to the
California Environmental Quality Act such that the proposed
modifications would not warrant the need of a new
environmental assessment .
Section 2 : Pursuant. to Zoning Ordinance Section 9402 . 00, the
City Council finds that:
a. The proposed pad modifications and building relocations
are not in keeping with the approved Planned Development
District application.
b. The shopping center is necessary for the development of
the northern. portion of the community as the area north of ,
Tahquitz Canyon Way is currently served by only one retail
center and yet the area contains a large portion of the City' s
residential area; however, the design of the shopping center
is not compatible with the surrounding community.
C. The proposed shopping center as modified is inconsistent
with the General Plan as it is not in harmony with the
community design objectives of the General Plan.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of
Palm Springs, California, hereby upholds the Planning commission
denial of the revised plans for Case 5 . 0631-PD-227/TPM 27975 .
