HomeMy WebLinkAbout18420 - RESOLUTIONS - 7/5/1994 RESOLUTION NO. 18420 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, RECITING THE FACTS OF THE GENERAL MUNICIPAL ELECTION HELD IN SAID CITY ON 7TH OF ' JUNE, 1994, DECLARING THE RESULT THEREOF AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW. WHEREAS a municipal election was held and conducted in the City of Palm Springs, California, on June 7, 1994, as required by law; and WHEREAS notice of said election was duly and regularly given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects said election was held and conducted and the votes cast thereat, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in cities; and WHEREAS on March 9, 1994, the City Council called a Special Municipal election to be consolidated with the June 7, 1994 statewide election, for the purpose of placing an advisory vote concerning City Utility User Tax; and a measure concerning a proposed charter. WHEREAS pursuant to Resolution 18279 adopted January 19, 1994, the City Clerk of said City has caused the canvass of the returns of said election and has certified the results to this City Council, said results are received, attached and made a part hereof as Exhibit A, NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs, as follows: Section 1. That there were 40 voting precincts established for the purpose of holding said election consisting of consolidations of the regular elections precincts in said City as established for the holding of state and county elections. Section 2. That said regular general municipal election was held for the purpose of electing the following officers of said City as required by laws relating to cities in the State of California, to-wit: Two Members of the City Council for full four-year terms. Section 3. That said consolidated special election was held for the purpose of submitting the following measures to the electors of said City; to-wit: MEASURE 1 R I - FOR ADVISORY VOTE ONLY Shall the City Utility Tax on users of telephone services, electricity, gas, and co-generated electricity be continued for no more than three years at a rate of 5% or less? MEASURE [ S ] Shall the Charter be adopted making Palm Springs a charter city so that the laws of Palm Springs shall prevail over state law with respect to municipal affairs? Section 4. That the names of persons voted for at said election for Member of the City Council of said City are, as follows: R18420 Page 2 Res. No. 18420 Page 2 Will Kleindienst Deyna L. Hodges Janet A. Gray Evan Morgan , Darrell Meeks. Bill Short Seymour "Sy" Lenes Fredrick McCarey Ebeling Section 6. That the measures voted upon at said election are: as follows: MEASURE f R 1 - FOR ADVISORY VOTE ONLY Shall the City Utility Tax on users of telephone services, electricity, gas, and co-generated electricity be; continued for no more: than three years at a rate of 5% or less? MEASURE r S I Shall the Charter be adopted making Palm Springs a charter city so that the laws of Palm Springs shall prevail over state law with respect to municipal affairs? Section 7. That the number of votes given at each precinct and the number of votes given in the City to each of such persons above named for the respective offices for which said person was a candidate, ,Sure as listed in Exhibit A attached. ' Section S. The City Council does hereby declare and determine that: William Kleindienst and Deyna L. Hodges were elected to a full four year term as a member of the City Council. Section 9. That as a result of said election, a majority of the qualified voters voting on Measure R relating to the Utility Users Tax did vote in favor thereof, an advisory vote only. That as a result of said election, a majority of the qualified voters voting on Measure S relating to the Proposed Charter did vote in favor thereof, and that said measure was approved. Section 10. The City Clerk shall enter on the records of the City Council of said City, a statement of result of said election, showing: (1) The measures voted upon and names of the persons voted for; (2) For what office each person was voted for; (3) The number of votes given at each precinct for and against each measure, and number of votes given to each person; (4) The number of votes given in the City for and against each measure, ' and the number of votes received by each person. That the City Clerk shall immediately make and deliver to each of such persons so elected a Certificate of Election signed by the City Clerk and duly authenticated; that the City Clerk shall also administer to each person elected, the oath of Office prescribed in the State Constitution of the State of California and shall have them subscribe thereto and file the same in the Office of the City Clerk. Whereupon, each and all of said persons so elected shall be included into the respective office to which they have been elected. ADOPTED this 5th day of July , 1994.
