HomeMy WebLinkAbout18415 - RESOLUTIONS - 6/15/1994 RESOLUTION NO. 18415 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING A SETTLEMENT AND COOPERATION AGREEMENT WITH THE RIVERSIDE COUNTY SUPERINTENDENT OF SCHOOLS PERTAINING TO THE REDEVELOPMENT PLAN FOR THE CANYON REDEVELOPMENT PROJECT AREA -' - - - - - - - - - - - - -WHEREAS, on July 19, 1991, the City Council of the city of Palm Springs adopted Ordinance No. 1388 approving the Redevelopment Plan for the Canyon Redevelopment Project (the "Plan") pursuant to the California Community Redevelopment law ("CRL") (Health & Safety Code 533000 et sea. ; and WHEREAS, the Plan delineates a redevelopment project area known as the Canyon Redevelopment Project Area ("the Project Area") ; and WHEREAS, the Riverside County Superintendent of Schools ("Superintendent") is an affected taxing entity, as defined in Section 33353 .2 of the Health and Safety Code, and levies ad valorem property taxes on real property within the Project Area; and WHEREAS, Superintendent has disputed the effect of the adoption of the Plan on the superintendent; and WHEREAS, representatives of Superintendent, on one side, and City and Agency on the other, have met and conferred in good faith to negotiate a resolution to Superintendent's concerns with respect to the Plan; and ' WHEREAS, Superintendent, City, and Agency desire to resolve and settle, once and for all times, all past, present, or future claims, disputes, or causes of action, both real and potential, arising against Agency and City in relationship to the Plan, and have proposed a Settlement and Cooperation Agency between the parties for that purpose; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Springs, California, as follows: Section 1: The City Council hereby approves the Settlement and Cooperation Agreement between the Riverside - County Superintendent of Schools, the city of Palm Springs, and the Community Redevelopment Agency of the City of Palm Springs described in the above Recitals, a copy of which Agreement is on file in the office of the City Clerk. The City Manager is hereby authorized to make any necessary final technical and clerical changes to the Agreement prior to its execution, in the form approved by the City Attorney, and the Mayor is authorized and directed to execute the agreement on behalf of the City.
