HomeMy WebLinkAbout18356 - RESOLUTIONS - 4/6/1994 RESOLUTION 18356 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA ESTABLISHING THE PRIORITIES AND DIRECTION OF THE CITY'S RECYCLING PROGRAM 1 - - - - - - - - - WHEREAS, the Council desires to comply with the requirements of California AB 939 and reduce the flow of its solid waste to the County landfills by the state-mandated goals of 25% by 1995 and 50% by the year 2000 and avoid the $10,000 per day fine for non-compliance; and WHEREAS, the County of Riverside owns and operates the landfills to which the waste generated in Palm Springs is currently sent; and WHEREAS, California Public Resources Code §41821..5 (AB 2494) requires that: (a) waste haulers provide information on the origin of waste delivered to a disposal facility, (b) recycling and composting facilities submit,periodic reports to the county on materials sold or transferred, and (c) counties submit periodic reports to their cities of amounts disposed and diverted; and WHEREAS, §6.04.260 of the Palm Springs Municipal Code, enacted in 1992, requires that all persons engaged in the collection or diversion of waste generated within the city, not operating under an Agreement with the City to provide waste management services, shall obtain a permit from the city and are required to report the type of materials diverted by type, weight, and volume; and ' WHEREAS, the high cost of transporting recyclable materials to Los Angeles area markets is an impediment to some recycling activities, which may be overcome with the development of some local processing facilities and end markets for certain materials; and WHEREAS, yard and wood waste used as a fuel at the Colmac Energy Facility currently does not count as a diversion credit; and WHEREAS, education of the public about how and why to recycle needs to be a major component of the City's recycling program; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Springs that the Council: Section 1. Requests that the County of Riverside immediately implement a data collection system to gather and disseminate information on the waste diversion activities to the cities of the county; and Section 2. Directs City staff to proceed with the establishment of a monitoring and reporting system authorized by Code §6.04.260 that would enable major retailers and others diverting waste outside of local channels, including construction firms, to report their diversion activities; and ' Section 3. Directs City staff to explore ways that the City can cooperate with the Coachella Valley Association of Governments, the Coachella Valley Recycling Market Development Zone, and other jurisdictions to make a concerted effort to attract businesses which would process recyclables locally; and R18356 ��� Page 2 Section 4. Requests that the California Integrated Waste Management Board, in its draft of final AB 939 guidelines, enable communities to receive diversion credit for refuse-derived fuels; and Section 5. Directs City staff, the Palm Springs Disposal Company, and the ' Citizens Recycling Advisory Committee to develop and implement a comprehensive program of public education about recycling.
