OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, APPROVING THE PRELIMINARY
AND FINAL PLANNED DEVELOPMENT DISTRICT (CASE
5 . 0663-PD-230) FOR THE 11, 090 SQUARE FOOT
SECOND FLOOR ADDITION TO THE EXISTING 65, 885
SQUARE FOOT PALM SPRINGS DESERT MUSEUM LOCATED
' AT 101 MUSEUM DRIVE, CBD ZONE, SECTION 15
WHEREAS the Desert Museum has submitted an application for a
Planned Development District in order to add an 11, 090 square foot
addition to the Museum, the Stephen Chase Wing, to house additional
galleries; and
WHEREAS in 1972, the Planning Commission approved the existing
65, 885 square foot Desert Museum and in 1980 approved an additional
administrative building for related office purposes; and
WHEREAS the Desert Museum has submitted an application for a
Planned Development District in order to exceed the permitted 30
foot height limit of the CBD Zone; and
WHEREAS the Zoning Ordinance allows for highrise buildings up to 60
feet in height in the CBD Zone in conjunction with a Planned
Development District; and
WHEREAS the Desert Museum was originally approved at a height of 38
feet; and
WHEREAS the proposed Desert Museum addition of 22 feet in height
would bring the total height of the Desert Museum building up to 55
feet; and
' WHEREAS the new addition will not be obtrusive to adjacent
properties due to its location in the rear of the property adjacent
to the toe of the mountain and the height of the exiting museum
building; and
WHEREAS the Desert Museum has submitted an application for a
Planned Development District to set forth an adequate parking
standard since the Zoning Ordinance does not set forth a parking
rate for a museum; and
WHEREAS the Desert Museum currently has a total of 146 on-site
parking spaces which will adequately serve the Desert Museum; and
WHEREAS the Desert Museum is requesting a reduction in the open
space requirements for highrise buildings from 601 to 58%; and
WHEREAS the Desert Museum addition is exempt according to the
California Environmental Quality Act (CEQA) .
WHEREAS the Planning Commission, at a public hearing on February
23, 1993, voted in favor of approval of the Preliminary and Final
Planned Development District (6-0; 1 abstention) ; and
WHEREAS notice of a public hearing of the City Council of the City
' of Palm Springs to consider the Desert Museum' s application for a
Preliminary and Final Planned Development District was given in
accordance with applicable law; and
WHEREAS the City Council has carefully reviewed and considered all
of the evidence presented in connection with the hearing on the
project, including but not limited to the staff report .
THE CITY COUNCIL HEREBY FINDS AS FOLLOWS :
Section 1 : Pursuant to CEQA, the City Council finds as
follows :

a. The project is categorically exempt from the
requirements of CEQA pursuant to Section
15301, Existing Facilities which allows for an
addition of 10, 000 square feet .
b. The proposed addition, although 11, 090 square
feet, slightly greater than the allowed 10, 000
square 'feet complies with this category for '
the following reasons :
1 . The addition will not create any additional
site coverage except for 500 square feet which
will require minimal grading;
2 . The 11, 090 square foot addition is being
built upon an existing structure of 65, 885
square feet resulting in only approximately
150s of the total development of the site; and,
3 . The: new addition which will house new
galleries and over 2000 square feet of
corridors, mechanical equipment rooms,
restrooms and stairwells most likely will not
create a significant increase in peak: time
usage nor cause any significant increase in
overall daily activity.
Section 2 : Pursuant to Section 9403 . 00 of the Zoning Ordinance
the City Council finds that :
a. That the use applied for at the location set
forth in the application is properly one for
which a Planned Development District is
authorized by the City' s Zoning Ordinance.
b. That the said use is necessary o'r desirable ,
for the development of the community, is in
harmony with the various elements or
objectives of the General Plan, and is not
detrimental to existing uses or to future uses
specifically permitted in the zone in which
the proposed use is to be located. The Palm
Springs Desert Museum is an important cultural
and educational amenity within this community;
the addition will be in harmony with and not
detrimental to the existing museum.
C. That the site for the intended use is adequate
in size - and shape to accommodate said use,
including' yards, setbacks, walls or fences,
landscaping and other features required in
order to adjust said use to those existing or
permitted future uses of land in the
neighborhood. The site is adequate such that
it will accommodate the proposed addition to
the existing museum while still maintaining
conformance with development standards set
forth in the Zoning Ordinance except for the
required height, parking and open space '
requirements for which this Planned
Development District is being requested..
d. That the parking requirement set forth for the
Desert Museum of 146 spaces is adequate to
accommodate the museum' s daily usage as well
as the special peak time events such as the
gallery openings and usage of the theater.
e . That the site for the proposed use relates to
streets and highways properly designed and
improved to carry the type and quantity of
traffic to be generated by the proposed use.

The proposed addition shall not create a
significant increase in usage such that
existing streets and highways would not
accommodate the addition.
f . That the conditions to be imposed and shown on
the approved site plan or in Exhibit A of this
' resolution are deemed necessary to protect the
public health, safety and general welfare and
may include minor modifications of the zone' s
property development standards .
NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the
City Council hereby approves the Preliminary and Final Planned
Development District 5 . 0663-PD-230, subject to those conditions set
forth in the attached Exhibit A, on file in the City Clerk' s
office, which are to be satisfied prior to the issuance of
certificates of occupancy unless otherwise specified.
