HomeMy WebLinkAbout18286 - RESOLUTIONS - 1/19/1994 RESOLUTION NO. 18286 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS AUTHORIZING EXECUTION OF INDEMNITY AGREEMENT WITH SURETY INDEMNITY COMPANY OF CALIFORNIA AND/OR DEVELOPERS INSURANCE COMPANY RE THE MUNICIPAL GOLF COURSE EXPANSION PROJECT AND PERFORMANCE ]BOND IN FAVOR OF THE U.S. ARMY CORPS OF ENGINEERS IN THE AMOUNT OF $200, 000 ' WHEREAS, the U.S. Army Corp of Engineers has required that the City of Palm Springs obtain a Surety Bond in the amount of $200,000 for the faithful performance of the conditions of the: 404 Permit No. 93-3.58-RS for a period of three to five years; and WHEREAS, Indemnity Company of California and./or Developers Insurance Company have agreed to provide such Performance Bond on behalf of the City of Palm Springs and in favor of the U.S. Army Corp of Engineers; and WHEREAS, Indemnity Company of California and./or Developers Insurance Company are approved Sureties by the U.S. Army Corp of Engineers; and WHEREAS, Surety Indemnity Company of California and/or Developers Insurance Company have required, as a condition to issuing the Performance Bond, that the City execute the Indemnity Agreement attached hereto; and WHEREAS, the Indemnity Agreement attached hereto required the City to pay all premiums as required by Surety Indemnity Company of California and/or Developers Insurance Company and further requires the City to hold such indemnification harmless from the matters set forth therein. ' NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Palm Springs hereby authorizes and warrants as follows: Section 1. The City Council warrants that it has full power and authority to enter into the attached Indemnity Agreement to authorize the execution of such Indemnity Agreement; and Section 2 . The City Manager is authorized and directed to execute the Indemnity Agreement on behalf of the City of Palm Springs, and Section 3 . The City Manager is hereby authorized to execute such amendments to said Indemnity Agreement as shall be necessary to implement the intent, terms and conditions of the Indemnity Agreement, in a form approved by the City Attorney.
