HomeMy WebLinkAbout18277 - RESOLUTIONS - 1/19/1994 RESOLUTION NO. 18277 C OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, f oq� CALIFORNIA, VACATING AND ABANDONING A PORTION OF EAST PALM CANYON DRIVE IN SECTION 30, TAS., R.SE. WHEREAS the City Council of the City of Palm Springs California is authorized by the Public Streets, Highways and Services Easements Vacation Law, Part 3, Division 9, of the Streets and Highways Code of the State of California, to vacate and close to public use, streets, or parts of streets, within the limits of said City; and WHEREAS heretofore the City Council did adopt a resolution declaring its intention to vacate and close the hereinafter referred to portion of East Palm Canyon Drive and the City Council did post notice as required by statute, and did hold a public hearing as required by the statute; and WHEREAS the Desert Water Agency and the Gene Autry Hotel have agreed to enter into a utility easement for a portion of the right-of-way being vacated, which is required for an existing water main; and WHEREAS the Planning Commission has determined that said right-of-way vacation is not in conflict with the City's General Plan; and WHEREAS the City Council found from all evidence submitted that the portion of East Palm Canyon Drive, as described in Exhibit "A" attached hereto, was and is unnecessary for present or prospective public street purposes, will not be used now or in the future, and that it is in the ' public's interest that the hereinafter described public right-of-way be vacated. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs, California, as follows: Section 1. That the City Council does hereby vacate all the city's rights, title, and interest in the north 26 feet of East Palm Canyon Drive, between Cherokee Way and Linden Way, as described in Exhibit "A" and shown on Exhibit "B", attached hereto and made a part hereof, a road within the City, County of Riverside, State of California. Section 2. That the City Clerk, upon receipt of a release from Desert Water Agency attesting that they concur in the vacation of said portion of right-of-way, is hereby directed to cause a certified copy of this resolution, attested to by her under the seal of the City, to be recorded in the Office of the County Recorder of Riverside County. The City Clerk is further directed to transmit a certified copy of this resolution to the County Survey of Riverside County. ADOPTED this 19th day of January 1994.
