OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORN:IA, APPROVING THE AMENDMENT
TO THE CANYON PARK RESORT AND SPA SPECIFIC
PLAN #1 (CASE 5. 0576-SP-1A) FOR A 74:6 .ACRE
AREA LOCATED SOUTH OF HURRAY CANYON DRIVE,
NORTH OF ACANTO WAY AND EAST AND WEST OF SOUTH
PALM CANYON DRIVE, W-R.-I-A, W-R-1-B, R-1-A, R-
l-B, R-2, 0-20, IR, U-]R ZONES, PD78 AND PD228,
PORTIONS OF SECTIONS :34, 35 AND 36 '
WHEREAS Canyon Development has submitted an application for, an
amendment to the City Council approved Canyon Park Resort Hotel and
Spa Specific Plan #1 (July of I.991) , pursuant to Government Code
Section 65450 for the properties it owns or controls 1:340 acres)
within Specific Plan #1 (SP--1) ; and
WHEREAS the City of Palm Springs has initiated and prepared the
Specific Plan Amendment for all properties not owned or leased by
Canyon Development (406 acres) with Specific Plan No. l; and
WHEREAS the amendment to the Specific Plan (SP-1A) entails the same
land uses as were approved in SP-1 including but not limited to, a
resort hotel and spa, retail and restaurant complex, single and
multi-family residential. dwelling units, a golf course, and tennis
courts, roadways and flood control facilities; and
WHEREAS the proposed amendment relocates the approved land uses
within the Specific Plan area, more specifically the resort hotel
and related facilities are proposed to be located in the lower
portion of the alluvial fan west of South Palm Canyon Drive and low
density residential units will be located east of South Palm Canyon
Drive; and
WHEREAS SP-lA proposes additional residential dwelling units (a ,
total of 1300 single and multi-family residential units) not to
exceed the density allotted for the Specific Plant area pursuant to
the City of Palm Springs General Plan; and
WHEREAS 'the Canyon Development portion of the proposed amendment
(340 acres) includes an up 'to 1, 250, 000 square :root resort hotel
and spa entailing 400 guest rooms, an up to 91, 800 square foot
retail and restaurant complex, 460 single and multi-family
residential units, an 18-hole golf course and golf clubhouse,
tennis courts, roadways and flood control facilities; and
WHEREAS the 406 acres of SP--1A not owned or controlled by Canyon
Development will be designated for low density residential dwelling
units, not to exceed the density permitted by the General Plan (a
total of 440 residential unri.ts) ;, and
WHEREAS some of the properties within the 406 acres of SP-lA not
owned or controlled by Canyon Development include existing
residential development or have entitlements for single-family
residential development and said entitlements will not be modified
under the amended Specific Plan; and
WHEREAS the proposed amendment is consistent withe the General Plan
and proposed General Plan ,Amendment; and
WHEREAS in July of 1991 the City Council certified The Canyon '
Redevelopment Plan and Canyon Park Resort and Spa Specific Plan
Final Environmental Impact Report, adopted a Statement of Fact and
Findings and a Statement of Overriding Considerations; and
WHEREAS in February of 1993 the City Council certified the General
Plan Update Environmental Impact: Report; and

WHEREAS the proposed amendment to the Specific Plan is considered
a "project" pursuant to the terms of the California Environmental
Quality Act (CEQA) and a Negative Declaration has been prepared for
the Canyon Park Resort and Spa project amendment and has been
distributed for public review and comment in accordance with CEQA;
' and
WHEREAS the Planning Commission has had the opportunity to review
this project at three publicly-noticed Planning Commission Study
Sessions prior the Planning Commission public hearing of December
22 , 1993 ; and
WHEREAS the Planning Commission has carefully reviewed and
considered all of the evidence presented in connection with the
hearing on the project, including but not limited to the staff
report and the environmental data including the Environmental
Analysis and voted in favor of approval of the proposed amendment
the Specific Plan (4-1; 1 abstention; 1 absent) .
WHEREAS the City Council has carefully reviewed and considered all
of the evidence presented in connection with the hearing on the
project, including but not limited to, the staff report and the
environmental data including the Environmental Assessment and
Negative Declaration; and
WHEREAS the City Council finds that the environmental effects of
the project have been fully considered and reviewed as part of the
Environmental Impact Reports, Environmental Assessment, and
Negative Declaration identified above.
NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the
City Council hereby approves Case 5.0576-SP-lA, an amendment to the
Canyon Park Resort and Spa Specific Plan #1.
