HomeMy WebLinkAbout18274 - RESOLUTIONS - 1/19/1994 RESOLUTION NO, 18274 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, ADOPTING A GENERAL PLAN AMENDMENT FOR THE CANYON PARK RESORT & SPA SPECIFIC PLAN ;r3 (CASE 5. 0576-SP-1A) FOR A 746 ACRE AREA LOCATED SOUTH OF MURRAY CANYON DRIVE, NORTH OF ACANTO WAY AND EAST AND WEST OF SOUTH PALM CANYON DRIVE, W-R-1-A, W-R-1-B, ' R-1-A, R-1--B, R-2, 01-20, W, U-R ZONES, P078 AND PD228, PORTIONS OF SECTIONS 34, 35 AND 36. WHEREAS Canyon Development has submitted an application for an amendment to the City Council approved Canyon Park Resort Hotel & Spa Specific Plan #1 (July 1991.) ; and WHEREAS the City of Palm Springs has initiated a General Plan Amendment in favor of the Specific Plan Amendment and has initiated and prepared the Specific Plan Amendment for all properties not owned or leased by Canyon Development; and WHEREAS the amendment to the Specific Plan (SP-1A.) entails the same land uses as were approved in SP--1 including, but riot limited to, a :resort hotel and spa, retail and restaurant complex, single-• and multi-family residential dwelling units, a golf course and tennis courts, roadways and flood control facilities; and WHEREAS the proposed amendment relocates the approved land uses within the Specific Plan area, more specifically the resort hotel and related facilities are proposed to be located in the lower portion of the alluvial fan west of South Palm Canyon Drive and low-density residential units will then be located east of South Palm Canyon Drive, and reinstates Bogert Trail as a collector street and eliminates Acanto Way as a collector street; and ' WHEREAS a General Plan Amendment has been prepared to reflect the locational and circulation changes proposed as part of the Canyon Park Resort Hotel & Spa Specific Plan Amendment proposal, and such changes will not cause any other substantive environmental change to the General Plan; and WHEREAS the City Council„ on March 3, 1993 , certified the Environmental Impact Report (EIR) regarding the General Plan Update which identified significant effects that may occur as a result of development consistent with the General Plan Update and adopted appropriate findings; and WHEREAS in July of 1991 the City Council certified The Canyon Redevelopment Plan and Canyon Park Resort and Spa Specific Plan Final Environmental Impact Report, adopted a Statement of Fact and Findings and a Statement of Overriding Considerations; and WHEREAS an environmental assessment was prepared for -the proposed Canyon Park Resort Hotel and Spa project, including the General Plan Amendment, resulting in the preparation of a Negative Declaration, and the approval of the subject project and its mitigated Negative Declaration :is consistent with the existing and proposed land uses fully discussed in the EIR fog:• the General Plan Update, and as such will not create any impacts beyond those ' analyzed in the EIR for the General Plan Update; and WHEREAS the City finds that since the time of the, certification of the EIR for the General Plan Update there have been no changes in the general plan program or the circumstances of such program involving new significant environmental impacts which would require important revisions in the ]EIR; and WHEREAS no new information has become available since the certification of the EIR which :indicates new environmental effects, I ` greater severity of previously identified effects, the feasibility \L\l of mitigation measures previously considered infeasible, or new mitigation measures which would substantially lessen one or more significant environmental effects; and Res. No. 18274 Page 2 V, WHEREAS the Planning Commission held a public hearing on December 22 , 1993, and voted in favor of the General Plan Amendment (5-0; 1 abstention; 1 absence) . NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council hereby approves the General_ Plan Amendment to the Land ' Use & Circulation Map of the General Plan, as shown on Exhibit A (as on file in the Office of the City Clerk) , and an amendment to the text of the General Plan, as shown on Exhibit B (as on file in the Office of the City Clerk) ; ADOPTED this 19th day of January , 1994.
