HomeMy WebLinkAbout18273 - RESOLUTIONS - 1/19/1994 RESOLUTION NO. 18273 OF THE CITY COUNCIL OF THE CITY OF' PALK SPRINGS, CALIFORNIA, CERTIFYING THE NEGATIVE DECLARATION FOR THE GENERAL PLAN AMENDMENT (CASE 5.0576-GPA•-1.A) , THE AMENDMENT TO THE CANYON PARK RESORT AND SPA SPECIFIC PLAN #1 (CASE 5. 0576-SP-1.A) , THE PLANNED DEVELOPMENT DISTRICT (CASE 5. 0576-PDD-217A) AND DEVELOPMENT AGREEMENT (CASE 5. 0576-DA-2) FOR A 746 ACRE AREA LOCATED SOUTH OF MURRAY CANYON ' DRIVE, NORTH OF ACANTO WAY AND EAST AND WEST OF SOUTH PALM CANYON DRIVE, W-R-1-A, W-•R-1-I3, R-1-A, R•-1-B, R-2, 0-20, W, U-R ZONES, PD78 AND PD228, PORTIONS OF SECTIONS 34, 35 AND 36 WHEREAS Canyon Development has submitted an application for an amendment to the approved Canyon Park Resort Hotel and Spa Specific Plan #1 (approved in July of 3.9191) , pursuant to Government Code Section 65450, entailing the same boundaries and acreage total (746 acres) as in Specific Plan #1; and WHEREAS the proposed amendment to the Specific Plan includes 340 acres owned or controlled by Canyon Development and 406 acres owned or controlled by various other parties; and WHEREAS Canyon Development has submitted an application for, and the City of Palm Springs has initiated a General Plan Amendment in favor of the Specific Plan Amendment; and WHEREAS Canyon Development has filed an application with the City for Preliminary Planned Development District and a Development Agreement for a 1, 250, 000 sgUare fool"c resort. hotel and spa entailing 400 guest rooms, a 91,800 square foot retail and restaurant complex, 460 single and multi-family residential units, ' an 18-hole golf course and golf clubhouse, a tennis complex, roadway improvements, :flood control facilities and other public and private improvements; and WHEREAS the Planning Commission at its December 22 , 1993, meeting voted in favor of ordering the filing of the Negative Declaration (5-0; 1 abstention; 1 absent) ; and WHEREAS notice of a public hearing of the City Council of the City of Palm Springs to consider the Applicant's applications for the General Plan Amendment, the Amendment to the Specific Plan #1, the Planned Development District 217A and the Negative Declaration; and WHEREAS in July of 1991 the City Council certified The Canyon Redevelopment Plan and Canyon ]Park Resort and Spa Specific Plan Final Environmental Impact :Report, adopted a Statement of Facts and Findings and a Statement of Overriding Considerations; and WHEREAS the proposed General Plan Amendment, Specific Plan Amendment, Planned Development District and Development Agreement are considered "projects" pursuant to the terms of the California Environmental Quality Act (CEQA) and a Negative Declaration has been prepared for the Canyon Park Resort and Spa Hotel amended project and has been distributed for public review and comment in accordance with CEQA (beginning on November 8, 1993 and extending to January 19, 199-4) ; and ' WHEREAS the Negative ]Declaration prepared for the project, finds that the proposed project will not have a significant negative impact on the environment and will not create any further impacts beyond those analyzed in the: Final. EIR for the Canyon Park, Resort Hotel and Spa Specific; Plan ,h51; and WHEREAS the City Council has carefully reviewed and considered all of the evidence presented in connection with the hearing on the project, including but not limited to the staff report and the environmental data including the Environmental Analysis and related comments. Res. No. 18273 Page 2 THE CITY COUNCIL HEREBY FINDS AS FOLLOWS: Section 1: Pursuant to CEQA, the City Council finds as follows: a. The final Negative Declaration has been completed in compliance with CEQA, the State CEQA Guidelines and the City's CEQA procedures. The City Council has independently reviewed and considered the information contained in the Negative Declaration and finds that it adequately discusses the significant environmental effects of the proposed project (including the proposed PDD-217A, General Plan Amendment, Amendment to Specific Plan f1 and the Development Agreement) , and that, on the basis of the initial study and comments received during the public review process, there is no substantial evidence that there will be any new significant adverse environmental effects as a result of the approval of this project because mitigation measures identified in the Negative Declaration and the previous Final EIR have been incorporated into the project which mitigate any potential significant environmental effects to a point acceptable within the community. The mitigation measures are adopted in the Conditions of Approval of this project as outlined in Exhibit A (as on file in the Office of the City Clerk) of this Resolution. The Planning Commission further finds that the Negative Declaration reflects its independent judgement. b. The Negative Declaration adequately covers the current project proposal such that no impacts will result from the amended project and that no additional impacts will result which were not already addressed in the Final EIR and the adopted Statement of Facts and Findings and Statement of overriding considerations for the for the approved Canyon Park ' Resort Hotel and Spa Specific Plan #1, C. The Mitigation Monitoring Program is in compliance with Public Resources Code Section 21081.6 and is required in order to assure compliance with the above referenced mitigation measures during project implementation. These mitigation measures are referenced in the Conditions of Approval. NOW THEREFORE BE IT RESOLVED that, based upon the foregoing the City Council hereby certifies the Negative Declaration (Exhibit A, as on file in the Office of the City Clerk) as in compliance with CEQA and adopts the Mitigation Monitoring Program relating to the General Plan Amendment, the Amendment to the Specific Plan ,#1, Planned Development District 217A and the Development Agreement. ADOPTED this 19th day of January 1994.
