HomeMy WebLinkAbout18272 - RESOLUTIONS - 1/19/1994 RESOLUTION NO. 18272 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, C.ALIFORNIA, FINDING THPLT THE REDEVELOPMENT AGENCY'S PROVIDING PUBLIC IMPROVEMENTS TO BE NECESSARY TO EFFECTUATE THE PURPOSES OF THE REDEVELOPMENT PLAN,; FINDING THAT THE PROVISION OF AN ART WORK IN LIEU OF PAYMENT OF FEES TO SATISFY THE REQUIREMENTS OF ' THE PUBLIC ART FEE PROGRAM AND DIRECTING THE PUBLIC ARTS COMMISSION TO DEVELOP AN AGREEMENT FOR THE PROVISION OF THE ART; IN CONNECTION WITH THE SUBSTANTIAL RENOVATION OF THE FORMER BANK OF AMERICA BUILDING LOCATED AT 101 NORTH PALM CANYON DRIVE AS PROPOSED BY RON MALONE OF CHEYENNE CATTLE COMPANY. WHEREAS, the former Bank of America Building located at the corner of North Palm Canyon Drive at Tahquitz Canyon Drive has remained vacant for an extended period of time in the heart of the Downtown area of Palm Springs; and WHEREAS, this building represents a key to the overall revitalization of the Downtown area as an arts and entertainment district, but requires extensive and extraordinary renovation to structural and mechanical systems in the building; and WHEREAS, Ron Malone of Cheyenne Cattle Company has prepared a concept plan for a major entertainment complex in this building and has successfully negotiated a 25-year sublease agreement with Bank of America for this purpose; and ' WHEREAS, Mr. Malone has retained architects and engineers to prepare an itemized Project Budget and they have identified $216, 000 in unanticipated costs which render this substantial renovation not feasible without some assistance from the City. WHEREAS, the Redevelopment Agency proposes to provide assistance by constructing certain public. improvements which would otherwise be required of the developer, and the City approves such assistence as being necessary to effectuate the Redevelopment, Plan pursuant to Health and Safety Code Section 33421. 1; and WHEREAS, Mr. Malone proposes to place artwork valued from $10- $15, 000 in the public :right of way, visible to the public, and may enter into an agreement to maintain said art work, subject to review by the Arts Commission, and the placement of such, artwork would be in lieu of payment of the Art Fee under Zoning Ordinance, Section 9311. 00. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Springs as follows: 1. The City Council finds that the provision by the Redevelopment Agency of $50, 000 of public improvements ' including installation of sidewalk pavers, specimen trees and irrigation, benches and planters, decorative landscaping and light fixtures at T'ahquitz and Palm Canyon, which improvements would otherwise be required to be installed by the developer, is necessary to effectuate the purposes of the Redevelopment Plan as provided in Health and Safety Code, Section 32421. 1. The City Council accepts the installation of public art in connection with the project in the public right of way, which art shall be maintained by the developer pursuant to an agreement approved by the Art Commission and in a form approved by the City Attorney, to be acceptable in lieu of payment of the Art Fee, pursuant to Zoning Ordinance, Section 9311. 00 and directs the Art Commission to work with the developer concerning the time of the artwork, location and. other issues. 3 . This approval is contingent on the applicant presenting evidence satisfactory to City Attorney that applicant has entered into a binding lease for the subject property.
