HomeMy WebLinkAbout18255 - RESOLUTIONS - 12/15/1993 11 RESOLUTION NO. 18255 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING THE DOWNTOWN (CBD) ARCHITECTURAL LIGHT GUIDELINES. WHEREAS, Property owners in the Downtown Business District have filed a request to install exterior decorative lighting pursuant to Section 9404.00E of the Zoning Ordinance; and WHEREAS, the proposed architectural lighting guidelines, attached 5 hereto as Exhibit A, were developed to mitigate the Planning Commission concerns and assure proper installation and maintenance procedures; and ' WHEREAS, the Planning Commission, at their regular meeting on November 10, 1993, by a 6-0-1 vote recommended to the City Council approval of the proposed guidelines; and WHEREAS, on December 15, 1993, the City Council of the City of Palm Springs considered the proposed guidelines in accordance with applicable law; and WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented in connection with the request, including but not limited to the staff report and all written and oral testimony presented. THE CITY COUNCIL HEREBY FINDS AS FOLLOWS: Section 1: Pursuant to CEQA, the City Council finds as follows: a. The project is categorically exempt from the requirements of CEQA pursuant to Section 15301. Section 2: Pursuant to Zoning Ordinance Section 9404 .00E, the City Council finds that: a. That the proposed exterior lighting program and criteria is in keeping with the parameters of the architectural review procedures for the City of Palm Springs. b. That the proposed exterior lighting program will enhance architectural features of buildings in the downtown thus promoting the renovation currently underway in the downtown area. 16 Page 2 r' c. That the proposed criteria will encourage creative architectural enhancements on buildings and quality installation of the light systems for buildings in the downtown area. NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council hereby approves the Architectural Lighting Guidelines ( attached hereto as Exhibit A) for the Central Business District (CBD) . Established boundary for the program - south of Alejo Road and north of Baristo Road, Palm Canyon Drive, side streets between T Palm Canyon Drive and Indian Canyon Drive. 2 . Limit the participation to property owners that participate in the downtown street light program. 3 . All participants shall be required to use the same light or equal. ' Proposed lights: Tokistar (Ls-105a) 2 watt/24 volt, rated at 10, 000 hrs. Installation of the lights shall be per manufacturers specifications which include but is not limited to the use of 3M Foam Core double stick tape, TP Staples and or a clamp. 4 . Every proposal shall be required to have Planning Commission approval under a Minor Architectural Approval application. 5. Encourage applicants to hire an architect or lighting engineer to lay out the concept of the lights on their buildings. 6. The installation of any light shall be limited to highlighting the profile of buildings and or to enhance architectural features on the building. 7. All lights shall be installed above head height (minimum height 710" above grade) or eave line. 8. All lights shall be soft white incandescent, 12" on center. 9. No flashing or tracing lights shall be permitted. 10. Existing lighting including but not limited to landscape lighting, architectural lighting, and window display lighting shall be evaluated and modified if deemed necessary in review of all lights. This includes twinkle lights in landscape areas. 11. Property owners shall be required to remove or repair the light system from the building if this fails to meet the criteria adopted by the Council. Property owners shall be put on notice to remove the light system if any of the following occurs: a. Three percent (3%) of the light system is burned out. b. The system has been off for a period of sixty (60) days or more. C. The system has lost the straight linear or curvlinear shape that enhanced the architectural features of the building due to poor installation or maintenance.
