K RESOLUTION NO. 18249 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, SETTING TIME AND PLACE FOR THE PUBLIC HEARING ON NECESSITY TO ORDER ACQUISITION BY EMINENT DOMAIN PROCEEDINGS WHEREAS the City of Palm Springs is interested in acquiring certain lands for the construction and installation of traffic signals at the intersection of Indian Canyon Drive and San Rafael Road in Sec. 2, Sec. 3, Sec. 34 and See. 35, and has pursued negotiation to accomplish said acquisition; and WHEREAS it is necessary that certain land acquisition be made in order to start constriction ' as scheduled, and under present construction schedules the City must proceed with obtaining Ir possession of said parcels in an expedition manor. WHEREAS at this time the City is desirous of setting a time and place for public hearing on the necessity to acquire the needed land not yet acquired for the said projects. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs, as follows: Section 1. That certain land acquisition necessary for the accomplishment of the traffic signal project at the intersection of Indian Canyon Drive and San Rafael Road is described in Exhibit A and shown on Exhibit B attached hereto and made a part hereof. Section 2. That notice is hereby given that on Wednesday January 5, 1994, at the hour of 7:30 o'clock P.M. in the City Council chambers at 3200 Tahquitz Canyon Way, Palm Springs, any and all persons whose land is to be + acquired will have an opportunity to appear and to be heard on the matter of the necessity to exercise the right of eminent domain to acquire land necessary for the proposed construction and installation of traffic signals at the intersection of Indian Canyon Drive and San Rafael Road. All persons objecting to the public interest and necessity for the project and the determination as to whether or not the project is planned or located in a manner which will be most compatible with the greatest public good and the necessity for the property to be acquired should be present at said time r and place, if they wish to be heard, pursuant to sections 1245.235 of the t Code of Civil Procedure. Section 3. The City Clerk is hereby directed to notice the property owners concerning adoption of the Resolution of Necessity as required by Code of Civil Procedure, Section 1240.030 and 1245.235.
