PLAN CHECK AND BUILDING PERMIT FEE DEPOSIT SYSTEM FOR DETACHED SINGLE FAMILY "I DWELLING CONSTRUCTION. 9JI 4 WHEREAS the City has, inthe past, determined plan check and ' Y building permit fees for detached single family dwelling construction based on valuation tables established in the Uniform Building Code as promulgated by the International. Conference of Building Officials; and WHEREAS the Attorney General of the State of California, in an opinion issued March 9, 1993, (No. 92-506) determined that, if a city charges building permit and similar fees based upon the Uniform Building Code valuation tables without supporting evidence regarding the relationship between the fees and services rendered, such fees are invalid to the extent they exceed the reasonable costs of providing the services rendered; and ' WHEREAS the City has not performed any study to determine whether. the Uniform Code Valuation tables reflect the City"s actual costs based, upon local conditions, and proposes to develop a system where applicants are charged the Cit:y's actual costs; and WHEREAS the City has determined the hourly cost: of employees providing said services, including factors for overhead and employee benefits; and , WHEREAS the City intends to track actual plan check and building permit costs by determining employee time and other costs incurred in providing the service, which are to be charged to each applicant; and WHEREAS, based on a staff survey of fee systems developed by other + jurisdictions, the City wishes to establish a deposit against which the actual cost of providing service will be charged, with additional expenses collected or refunds paid prior to approval; and .- WHEREAS the City is in the process of determining an appropriate fee schedule for other types of plan check: and building permits. NOW THEREFORE BE IT RESOLVED AS FOLLOWS: ' SECTION 1. That the applicant for construction of any detached single family dwelling shall pay plan check and ' building permit fees based on the actual cost to the city of the services provided. Such costs shall be determined and paid as provided below. SECTION 2. That "actual cost" shall mean the number of hours expended in providing the services rendered multiplied by the hourly rate, including all overhead expense of the employees involved in processing the project, as determined by the City. + The services include plan check, :inspection, and processing costs. SECTION 3. That, at the time of submission of plans for plan . check of a detached single family dwelling, the applicant shall pay a Plan Check Fee Deposit, the amount of which shall be determined as outlined in Exhibit "A". The actual cost of providing plan check related services shall be billed against this l , deposit. The applicant, upon request of the City, 106�' +- Resolution No. 18204 Fees ' Page 2 shall supplement the deposit as necessary to maintain an adequate balance. At the time of approval of the building plans, final reconciliation of the amount shall be made by the - Director of Building and Safety with any additional amounts due paid or excess deposit funds reimbursed. SECTION 4. That, at the time of issuance of a building permit for a detached single family dwelling, the applicant shall pay a Building Permit Fee Deposit, the amount of which shall be determined as outlined in Exhibit "B". The actual cost of providing building permit related services shall be billed against this deposit. The applicant, upon request ` of the City, shall supplement the deposit as necessary to maintain an adequate balance. Prior to the issuance of the Certificate of Occupancy, or the release of utilities, a final reconciliation of the amount shall be made by the Director of Building and Safety with any additional amounts due paid, or excess deposit funds reimbursed. + SECTION 5. That the City shall track actual plan check and building permit costs over a period of time and may revise the fee program at a later dace based on the ' information developed during that review.
