HomeMy WebLinkAbout18191 - RESOLUTIONS - 10/6/1993RESOLUTION NO. 18191 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING A :LAND USE PERMIT FOR THE PALM SPRINGS EXOTIC CAR AUCTIONS FOR. CAR AUCTIONS AT THE RIVIERA RESORT HOTEL LOCATED AT 1800 N. INDIAN CANYON DR., R-3 ZONE, SECTION 2. WHEREAS, the Palm Springs Car Auctions (Keith McCormick), the applicant, has filed an application for a Land Use Permit pursuant to Section 9402.01 of the Zoning Ordinance for the proposed car auctions to be held on October 30 & 31, 1993, and February 26 & 27, 1994, at the Riviera Resort Hotel located at 1800 N. Indian Canyon Dr., R-3 Zane, Section 2; and WHEREAS, on September 8, 1993, at a regular Planning Commission meeting, the application for a :Land Use Permit was considered in accordance with applicable law; and WHEREAS, the Planning Commission recommended to the City Council approval of the Land Use Permit as submitted; and WHEREAS, on October 6, 1993, the City Council considered the application for the Land Use Permit in accordance with applicable law. NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council hereby approves the Land Use Permit as requested. Section 1: Pursuant to Zoning Ordinance Section 9402.01, the City Council finds that: a. The use applied for at the: location set forth in the application is properly one for which a land use permit is authorized by the City's Zoning Ordinance. b. The use applied for is desirable: for the development of the community, is in harmony with the various elements or objectives of the General Plan, and is not detrimental to existing uses specifically permitted in the zone in which the proposed use is to be located. C. The site for the intended use is adequate in size and shape to accommodate said use, including yards, setbacks, walls or fences, landscaping and other features required in order to adjust said use to those existing uses of the land in the neighborhood. d. The site for the proposed use relates to streets and highways properly designed and improved to carry the type and quantity of traffic to be generated by the proposed use. C. The conditions attached to the permit are deemed necessary to protect the public health, safety and general welfare.
