OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, ESTABLISHING THE
GAMING TASK FORCE
WHEREAS, the Tribal Council of the Agua Caliente Band of
Cahuilla Indians is currently considering various gaming
possibilities; and
WHEREAS, it is in the City's interest to evaluate and,
possibly, coordinate the City's gaming interests with those of "
the Agua Caliente Band of C:ahuilla Indians; and
WHEREAS, the City Council offered to involve the Tribal
Council in the Gaming Task Force; and
WHEREAS, the Tribal Council has indicated support for the
creation of a Gaming Task Force, it requested not to be
included in the Task Force membership; and
WHEREAS, it is in the City's interest to evaluate the
costs and benefits, both economic and social, of various 'I
potential gaming activities within the City :Limits, including
the long term effects on the City's tourism and economic
development.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Palm Springs, as follows:
Section 1. Creation. There is hereby created in and for
the City of Palm Springs a Gaming Task Force (11GTF11). '
Section 2. Purpose. The purposes of the GTF are as
follows: `
(a) To evaluate the direct and indirect benefits
(socioeconomic, promotional., entrepreneurial., etc.) of gaming
within the City;
(b) To evaluate the financial, societal, and other
direct and indirect costs of gaming within the City;
(c) To review potential gaming impacts on the >
City's long-term tourism and economic development program;
(d) To receive, process, and respond to citizen
gaming inquiries;
(e) To recommend to Council actions which might
expedite gaming development beneficial to the City;
(f) To recommend (where possible) gaming zoning ,
restrictions and compatible uses (restaurants, hotels, etc.);
(g) To evaluate gaming legislation (federal, state, ,
local) as it pertains, or may pertain., to the City;
(h) To identify the impact of gaming upon City
services and revenues to support any related service level
increases;

(i) To consider the implications of Class II versus
Class III gaming within the City;
(j) To consider and review other cities' or
agencies' experiences with gaming.
The final result of the GTF's work shall be a written report
to the City Council, incorporating all of the above -discussed
considerations. The initial report of the GTF shall be
submitted to the City Council no later than six (6) months
following its initial meeting following appointment.
• Section 3. Makeup of GTF. It is the City Council's
intent that the GTF reflect a broad base of interests of the
Palm Springs community, including, but not limited to, the
business community and downtown business interests, the
hospitality industry, the retail industry, the restaurant
industry, and the residents of Palm Springs at large.
Section 4. Comoosition. The GTF shall consist of eleven
(11) members.
Section 5. Aonointment. The members of the GTF shall be
appointed in conformity with Resolution No. 18020 governing
appointments to City boards and commissions.
Section 6. Term.

(a) The GTF shall be in existence for and the term
of each member thereof shall be for a maximum of one (1) year
from the date of the adoption of this resolution, or until a
report of the GTF making findings and recommendations to the
City Council as required by Section 2 hereof is acted upon by
the Council, whichever shall first occur. The GTF shall be
disbanded automatically at the end of this term, unless
extended by the City Council by amendment of this Resolution.
(b) Any member may resign with prior written notice
to the GTF chairperson and City Council. Any member may be
removed at any time by a majority vote of the City Council.
(c) No member may serve on any other City of Palm
Springs committee or commission while serving on the GTF nor
shall any member be an employee or considered for employment
by the City of Palm Springs while serving on the GTF.
(d) If any GTF member misses more than three
meetings that member shall be removed from the GTF by the
chairperson with notice, in writing, of such action being
taken given to the person and the City Council. A replacement
member shall thereafter be appointed in the manner set forth
in Section 5.
Section 7. Residencv. Prospective members of the GTF
shall be residents and registered voters of the City of Palm
Springs.
Section B. Financial Interest. Persons who participate
in the GTF will be precluded from having any financial
interest in gaming in the City of Palm Springs during their
service on the GTF, or for one year thereafter. Violation of
this restriction shall be deemed a misdemeanor punishable as
provided in the Palm Springs Municipal Code. For purposes of
determining whether a member has a "financial interest" in
gaming in the City of Palm Springs, the term "financial
interest" shall have the meaning applied to that term pursuant

to the Political Reform Act of 1974 (Government Code § 81000,
et seg.). Violation of this provision shall be grounds for
revocation of any City permit.
Section 9. Meetings.
(a) Following appointment, the GTF' shall, at its
first meeting, select a chairperson whose term of office shall
be concurrent with his/her term of appointment.
(b) At any meeting of the GTF, the majority of the
members shall constitute a quorum for purposes of conducting
business or meetings.
(c) The GTF shall be an advisory body to the: City
Council. All business of the GTF shall be conducted in
compliance with the Ralph M. Brown Act (Government Code §
54950, et sea.) and all GTF meetings shall be open and public.
(d) All GTF meetings shall be held in the Palm
Springs City Hall unless otherwise directed by the GTF. The
meeting time and day of such. meeting shall be: determined at
the first convened GTF meeting, and established by resolution
of the GTF.
(e) The GTF shall keep a record of its proceedings
which shall be a public record.
(f) The GTF and its members shall be subject to the
terms of the Political Reform Act of 1974.
(g) The proceedings of the GTF shall be conducted
in accordance with Robert's Rules of Order.
Section 10. Staffing. The City Manager may determine it
appropriate to, and may designate as the ex-officio
representative(s) to the GTF, one or more members of the: City
staff.
Section 11. Comoensat:ion. Members of the GTF shall
serve without compensation for their services.
