HomeMy WebLinkAbout18146 - RESOLUTIONS - 7/21/1993 RESOLUTION NO. 18146 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, 1; CALIFORNIA APPROVING THE EXCHANGE OF THREE- AND-ONE-QUARTER ACRES OF CITY OWNED LAND AT THE SOUTHEAST CORNER OF AVENIDA CABALLEROS AND BARISTO ROAD FOR FORTY-ONE ACRES OF INDIAN OWNED LAND IN THE NORTHEAST QUARTER OF SECTION 6. WHEREAS the Indian property owners of forty-one acres of land in the northeast quarter of ~ Section 6, more particularly described in Exhibit A, and shown on the map attached thereto, said forty-one acres having a value of$400,000.00 have agreed to exchange said forty-one acres for three-and-one-quarter acres of City-owned land located at the southeast corner of Avenida Caballeros and Baristo Road, more particularly described in Exhibit B and shown on the map attached thereto, having a value of$325,000.00, plus $75,000.00 in cash; and WHEREAS appraisals have established that the value placed on the forty-one acres and the value placed on the three-and-one-quarter acres is the fair market value of the subject land; and WHEREAS the three-and-one-quarter acres of land in Section 14 was acquired for the purpose of exchanging it for the subject forty-one acres; and WHEREAS the forty-one acre parcel in Section 6 is being acquired for City Yard, Fire Station, Waste Water Treatment Facilities and other general government purposes from Capital Improvement Project No. 91-06, the north end Waste Water Treatment Plant site. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs, as follows: Section 1. That the City Council approves the exchange of three-and-one-quarter acres of City-owned property in Section 14 plus $75,000.00 ,cash for r forty-one acres of Indian owned land located in the northeast quarter of tr' Section 6 valued at $400,000.00 plus pay title fee, escrow fees, recording fees and Bureau of Indian Affairs processing fee. Section 2. That James Stewart, doing business as Group One Services is hereby ► appointed and approved as the City's agent of record for this transaction and shall be compensated 5% of the sum paid for the subject land. Section 3. That the City Manager and City Clerk are hereby authorized to sign all documents approved by the City Attorney on behalf of the City of Palm Springs necessary to consummate the acquisition of the said land. Section 4. That the City Clerk is hereby authorized to accept the Deed and arrange for it to be recorded in the County Recorder's Office on behalf of the City of Palm Springs.
