OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, CERTIFYING THE FINAL
ENVIRONMENTAL IMPACT REPORT FOR THE ANNEXATION
STUDY AS COMPLETE, ADOPTING THE CORRESPONDING
STATEMENT OF FACTS AND FINDINGS, ADOPTING THE
STATEMENT OF OVERRIDING CONSIDERATIONS AND
ADOPTING THE MITIGATION MONITORING PROGRAM
(CASE 5. 0593-MISC. ) .
WHEREAS a request for a change of organization and amendment. to the
Sphere of Influence boundaries has been occasioned by requests by
landowners to annex their lands north of the existing city limit
within the Interstate 10 corridor to the City of Palm Springs; and
WHEREAS the City Council of the City of Palm Springs directed staff
to prepare an Annexation Study; and
WHEREAS an Environmental Impact Report (EIR) was prepared to assess
the impact of development within the Annexation Study area under
the City's General Plan; and
WHEREAS the Planning Commission considered the EIR at a public
hearing on April 28, 1993, and :recommended certification of the
Final EIR as adequate and in compliance with the California
Environmental Quality Act (CEQA) , and found that any significant
impacts outlined in the Report will be adequately mitigated or that
there are overriding considerations to render such impacts
acceptable; and
WHEREAS this Council did hold a public hearing on Annexation #26
and on the Environmental Impact Report, and received due discussion
and deliberation of said EIR, and is in agreement with the
recommendation of the Plann-ing Commission; and
WHEREAS the City Council has carefully reviewed and considered all
of the evidence presented in connection with the hearing on the
Annexation Study, including the initial study, the Draft EIR, the
proposed Final EIR, and all written and oral testimony presented.
Section 1. Pursuant to CEQA, the City Council finds that a
Final Environmental Impact Report has been prepared
and completed in compliance with CEQA, the State
CEQA Guidelines, and the City's CEQA Guidelines,
the EIR adequately addressee the general
environmental setting of the proposed Project, its
significant environmental impacts, and the
alternatives and mitigation measures related to
each significant environmental effect for the
proposed Project.. The City, council has
independently reviewed and considered the
information contained in the EIR prior to its
review of the: Project. The City Council therefore
approves and certifies the Environmental Impact
Report as complete:.
Section 2 . The City Council has reviewed and analyzed
information contained in the Final Environmental
Impact Report prior to taking action on Case
5. 0593-MISC. and certifies the Environmental Impact
Report as complete. The EIR reflects the
independent judgment of the City Council. The City
Council further adopts the Statement of Findings &
Facts and incorporates same herein by reference.
The City Council finds that the mitigation measures
identified in the Statement are necessary to 'reduce
or avoid significant impact and that certain
impacts, as identified in the Statement, even with
implementation of all recommended mitigation
measures, will remain significant and the City

Council further adopts the Statement of Overriding
Considerations and incorporates same herein be
reference.
Section 3 . By adoption of this resolution, the City Council of
the City of Palm Springs adopts the Mitigation
Monitoring Program for the Annexation Study (Case
5.0593-MISC. ) and incorporates same herein by
' reference.
NOW THEREFORE BE IT RESOLVED that, based upon the foregoing, the
City council hereby certifies the Environmental Impact Report as
complete and in conformity with CEQA, adopts the Statement of Facts
& Findings, adopts the Statement of Overriding Considerations, and
adopts the Mitigation Monitoring Program relating to Case 5. 0593-
MISC.
ADOPTED this 19th day of May , 1993 .
