OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, APPROVING CASE 5. 0609-
PLANNED DEVELOPMENT DISTRICT-224 FOR A
DESTINATION RESORT PROJECT COMPOSED OF AN IS-
HOLE CHAMPIONSHIP GOLF COURSE, A
SPA/FITNESS/TENNIS FACILITY, 135 SINGLE FAMILY
AND LUXURY ESTATE HOMES, AND A 270 UNIT LODGE
FACILITY CONSISTING OF A 60 UNIT HOTEL
BUILDING, 10 LUXURY BUNGALOWS AND 200 LUXURY
CONDOMINIUMS AND TWO ALTERNATIVE DEVELOPMENT
SCENARIOS FOR PROPERTY LOCATED ON TRAMWAY ROAD
1. 5 MILES WEST OF HIGHWAY 111, U-R AND 0--20
ZONES, SECTIONS 5, 6 AND 8.
WHEREAS, Shadowrock Ventures, (the "Applicant") has filed an
application with the City pursuant to Section 9402 . 00 of the Zoning
Code for a preliminary Planned Development District for a
destination resort project composed of an 18-hole championship golf
course, a spa/fitness/tennis facility, 135 single family and luxury
estate homes and a 270 unit lodge facility consisting of a 60 unit
hotel building, 10 luxury bungalows and 200 luxury condominiums
(the "Baseline Project") and two alternative development scenarios,
one alternative would include an 18-hole championship golf course,
a spa/fitness/tennis facility, 135 single family and luxury estate
homers and a 490 unit hotel (the "Hotel Scenario") , the other
alternative would include an 18-1.,Iole championship golf course and
211 single family and luxury estate homes (the "Residential
Scenario") , which 'three alternatives are collectively referred to
as the "Project" , located on. Tramway Road 1.5 miles west of Highway
ill, U-R and 0-20 Zones, Sections 5, 6 and 8 ; and
WHEREAS, notice of a public hearing of the Planning Commission of
the City of Palm Springs to consider the Applicant's application
for Planned Development District 224, was given in accordance with
applicable law; and
WHEREAS, on April 14 and April 21, 1993 , public hearings on the
application for Planned Development District 224, were held by the
Planning Commission in accordance with applicable: law; and
WHEREAS, the proposed Planned Development District 224 is
considered a "project" pursuant to the terms of the California
Environmental Quality Act (010EQA11) , and an Environmental Impact
Report has been prepared for this project and has been distributed
for public review and comment in accordance with CEQA; and
WHEREAS, at the conclusion of its public hearing on April 21, 1993 ,
the Planning Commission adopted Resolution No. 4:236 recommending
that the City Council approve Planned Development District 224,
subject to the findings and conditions stated in Resolution No,
4236; and
WHEREAS, notice of a public hearing of the City Council of the City
of Palm Springs to consider Planned Development District 224, was
given in accordance with applicable law; and

WHEREAS, on May 5, 1993 , a public hearing on the application for
r Planned Development District 224, was held by the City council in
accordance with applicable law; and
WHEREAS, pursuant to Government Code Section 65863 . 6, the City
Council has considered the effect of this Project on the housing
needs of the region in which Palm Springs is situated and has
balanced these needs against the public service needs of its
residents and available fiscal and environmental resources; the
project approval embodied herein, moreover, represents a balance of
the respective needs which is most consistent with the City's
obligation pursuant to its police powers to protect the public
health, safety and welfare; and
WHEREAS, the City Council has carefully reviewed and considered all
of the evidence presented in connection with the hearing on the
Project, including but not limited to the staff report, all
environmental data including the initial study, the proposed
Environmental Impact Report and all written and oral testimony
presented.
THE CITY COUNCIL HEREBY FINDS A FOLLOWS:
Section 1: City Council hereby reaffirms findings made in
Resolution No. 18086 pursuant CEQA.
Section 2 : Pursuant to Ordinance Section 9403 . 00B, the City
Council finds that:
a. The uses applied for at the location set forth in the
application are properly ones for which a Planned Development
District is authorized by the City's Zoning Ordinance.
b. The economic and fiscal benefit of the project, provision
of jobs, improvements to Tramway Road safety and flood control
facilities and preservation of hillsides on the project site
all constitute necessary and desirable impacts to the
development of the community.
C. The project will implement the City's General Plan goals
for the Chino Cone area which is to develop the Chino Cone
alluvial fan emphasizing resort development.
d. The site for the intended uses is adequate in size and
shape to accommodate said uses, including yards, setbacks,
walls or fences, landscaping and other features required in
order to adjust said uses to those existing or permitted
future uses of the land in the neighborhood.
e. The project will contribute to the improvement of Tramway
Road from capacity and safety perspectives creating a roadway
that is properly designed and improved to carry the type and
quantity of traffic to be generated by the proposed use.
f. The conditions to be imposed as contained in Exhibit A and
Mitigation Monitoring Program and shown on the approved site
plan are deemed necessary to protect the public health, safety
and general welfare, including any minor modifications of the
zone's property development standards.

NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing,
the City Council hereby approves the preliminary Planned
Development District 224 including the Baseline Project„ the Hotel
and Residential Scenarios, subject to those conditions set forth in
Exhibit A on file in the City Clerk's office, which are to be
satisfied prior to the issuance of Certificates of Occupancy unless
otherwise specified.
