OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CERTIFYING THE ENVIRONMENTAL IMPACT
REPORT AS COMPLETE, ADOPTING THE CORRESPONDING
STATEMENT OF FACTS & FINDINGS, ADOPTING THE
STATEMENT OF OVERRIDING CONSIDERATIONS AND
ADOPTING THE MITIGATION MONITORING PROGRAM
RELATING 'TO CASE 5.U605 ••PLANNED DEVELCIPMENT
DISTRICT-224
WHEREAS, Shadowrock Ventures (the "Applicant") has filed an
application with the City pursuant to Zoning Code Section 9403 . 00
for a Planned Development District for a destination resort project
composed of an 18-hole championship golf course, a
spa/fitness/tennis facility, 1.35 single family and luxury estate
homes and a 270 unit lodge facility consisting of a 60 unit hotel
building, 10 luxury bungalows and. 200 luxury condominiums and two
alternative development scenarios, one alternative would include an
18-hole championship golf course, a spa/fitness/tennis facility,
135 single family and luxury estate homes and a 490 unit hotel, the
other alternative would include an 18-hole championship golf course
and 211 single family and luxury estate homes (the "Project") ,
located on Tramway Road 1.5 miles west of Highway 111, U-R and 0-20
Zones, Sections 5, 6 and 8 ; and
WHEREAS, the proposed development is considered a "project"
pursuant to the terms of the California Environmental Quality Act
("CEQA") , and an Environmental Impact Report has been prepared for '
this Project and has been distributed for public review and comment
in accordance with CEQA;
WHEREAS, on February 10, April 14 and April 21, 1993 the Planning
Commission of the City of Palm Springs held duly noticed public
hearings with respect to the Project;
WHEREAS, at the conclusion of its public hearing on April 21, 1993 ,
the Planning Commission adopted Resolution No. 42:37 recommending
that the City Council certify the environmental impact as complete,
adopt the corresponding statement of facts and findings, adopt the
statement of overriding considerations and adopt the mitigation
monitoring program relating to Case. 0560-Planned Development
District-224 approve Planned Development District 224; and
WHEREAS, on May 5, 1993 , the City Council of the City of Palm
Springs held a duly noticed public hearing with respect to the
Project;
WHEREAS, the City Council has carefully reviewed and considered all
of the evidence presented in connection with the hearing on the
Project, including but not limited to the staff report, all
environmental data including the initial study , the proposed
Environmental Impact Report and all written and oral testimony
presented.

THE CITY COUNCIL HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant to CEQA, the City Council finds that a
final Environmental Impart Report has been prepared
and completed in compliance with CEQA, the State
CEQA Guidelines, and the City's CEQA Guidelines;
the EIR adequately addresses the general
environmental setting of the proposed Project, its
significant environmental impacts, and the
alternatives and mitigation measures related to
each significant environmental effect for the
proposed Project. The City Council has
independently reviewed and considered the
information contained in the EIR prior to its
review of this Project. The City Council therefore
approves and certifies the Environmental Impact
Report as complete.
F Section 2 : The City Council has reviewed and analyzed
information contained in the Final Environmental
Report prior to taking action on the Planned
Development District and certifies the
Environmental Impact Report as complete. The EIR
reflects the independent judgment of the City
Council. The City Council further adopts of the
Statement of Findings & Facts and incorporates same
herein by reference. The City Council finds that
the mitigation measures identified in the Statement
are necessary to reduce or avoid significant impact
and that certain impacts, as identified in the
Statement, even with implementation of all
recommended mitigation measures, will remain
significant and the City Council further adopts the
Statement of Overriding Considerations and
incorporates same herein by reference.
Section 3 : By adoption of this resolution, the City Council
adopts the Mitigation Monitoring Program for the
Environmental Impact Report for Case 5. 0609-PD-224
and incorporates same herein by reference.
NOW THEREFORE BE IT RESOLVED that, based upon the foregoing,
the City Council hereby certifies the Environmental Impact Report
as complete and in conformity with CEQA, adopts the Statement of
Facts & Findings, adopts the Statement of Overriding
Considerations, and adopts the Mitigation Monitoring Program
relating to Case 5. 0609-PD-224 .
