OF THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA, SETTING
TIME AND PLACE FOR PUBLIC HEARING OF
NECESSITY TO ORDER ACQUISITION BY
EMINENT DOMAIN PROCEEDINGS, A
REVERSIONARY INTEREST IN 30.29 ACRES
OF LAND KNOWN AS THE MCCALLUM TRUST
PROPERTY ON EL CIELO ROAD IN SECTION
19.
WHEREAS the City of Palm Springs has been actively engaged in the
acquisition of the reversionary interest of the Living Desert
Reserve in 30.29 acres of land known as the McCallum Trust Property
located on the east side of El Cielo Road and south of Mesquite
Avenue in Section 19, for open space and public recreation, because
the property is flood prone, unimproved and the reversionary
interest could prevent combining the said property with other
property in the City's open space and recreation system.
WHEREAS, at this time the City is desirous of setting a time and
place for public hearing on the necessity to acquire the needed
land for the said project.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of
Palm Springs, California, as follows:
Section 1: That the above citations are all true and correct.
Section 2 : That the certain property the City desires to
acquire for open space and public recreation is
described and shown on the property boundary map
attached hereto and made a part hereof marked
Exhibit "A".
Section 3: That notice is hereby given that on Wednesday,
February 17, 1993, at the hour of 7: 30 p.m. in the
City Council Chambers at 3200 E. Tahquitz Canyon
Way, Palm Springs, any and all persons whose land
is to be acquired will have an opportunity to
appear and be heard on the matter of the necessity
to exercise the right of eminent domain to acquire
land necessary for open space and public
recreation. All persons objecting to the public
interest and necessity for the project and the
determination as to whether or not the project is
planned and/or located in a manner which will be
most compatible with the greatest public good and
the necessity for the property to be acquired
should be present at said time and place if they
wish to be heard pursuant to Sections 1245.235 of
the Code of Civil Procedure.

Section 4. Staff is hereby directed to notice the property
owners concerning adoption of the Resolution of
Necessity as required by Code of Civil Procedure,
Section .1240. 030 and 1245.235. '

EXHIBIT "A"
Description of 30.29 acres on El Cielo Road known as the
McCallum Trust property, said property is located in the City of
Palm Springs, County of Riverside, State of California:
Lots 21, 22 and 23, and the North half of Lot 24 in Section 19,
Township 4 South, Range 5 East, San Bernardino Base and
Meridian, as shown by Map of PALM VALLEY COLONY
LAND on file in Book 14 page 652, of Maps, Records of
Riverside County, California;
EXCEPTING from said Lots 21, 22 and 23, the following
described land:
BEGINNING at the Northeast corner of said Lot 21;
THENCE South 00 00' 35" West along the Easterly line of said
Lot 21, a distance of 1317.77 feet to the Southeast corner thereof;
THENCE North 89 51' 00" West along the Southerly line of said
Lot 21, a distance of 344.23 feet to a point of intersection with the
Southwesterly line of that certain parcel of land shown and
delineated as Parcel 6060-144 on Record of Survey, on file in
Book 57 pages 3 through 16, inclusive, of Records of Survey,
Records of Riverside County, California;
THENCE North 56 58' 44" West along said Southwesterly line,
a distance of 1998.52 feet to the Westerly line of said Lot 23;
THENCE North 0 08' 53" East along said Westerly line, a
distance of 236.10 feet to the Northwest corner of said Lot 23;
THENCE South 89 45' 51" East along the Northerly line of said
Lot 23, 22, and 21, a distance of 2019.63 feet to the Point of
Beginning.
