HomeMy WebLinkAbout18004 - RESOLUTIONS - 12/16/1992 r RESOLUTION NO. 18004 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA DECLARING ITS INTENT TO DISESTABLISH THE DOWNTOWN BUSINESS IMPROVEMENT DISTRICT, TO PROVIDE FOR THE DISPOSITION OF ITS REMAINING ASSETS, AND TO FIX THE TIME AND PLACE OF A HEARING TO BE HELD BY THE CITY COUNCIL TO CONSIDER DISESTAB- LISHMENT OF THE DISTRICT. WHEREAS, the Downtown Business Improvement District was established by City Ordinance No. 1340 on September 26, 1989; and WHEREAS, the businesses protesting the District have approached 50% of the total District as measured in total dollar assessments, and have ' exceeded 50% as measured by the total number of business; and WHEREAS, the original goals of the District have not been substantially achieved; and WHEREAS, the City Council on October 7, 1992 voted 'to not approve an assessment for Fiscal year 1992-93. NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, that it intends to disestablish the Downtown Business Improvement District under the provisions established by the Parking and Business Improvement Area Laws of 1979, and commencing with Section 36500 of the Streets and Highways Code and with the following conditions: r'1 Section 1. That the remaining assets of the Downtown Business Improvement District be sold, and the proceeds used to offset the legal costs incurred by the City in defending the District, and to cover the additional costs of postage, public notice and collection of assessments due from prior fiscal years. Section 2. That Wednesday, January 6, 1993, at 7:30 PM in the Council Chambers of the Palm Springs City Hall , 3200 Tahquitz Canyon Way, Palm Springs, California is hereby fixed and designated ' as the date, hour and place of a hearing to be held by the Palm Springs City Council to consider the disestablishment of the Downtown Business Improvement District. Section 3. That a complete copy of this resolution be mailed to each business owner in the District via first-class mail within ` seven days of the City Council 's adoption of the resolution of intention. ADOPTED this 18th day of December, 1992.
