RESOLUTION NO. 17988
OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, APPROVING A 3.0%
INCREASE IN CERTAIN TRASH SERVICE FETES,
EFFECTIVE JANUARY 1, 1993 AND AMENDING '
SECTION 12.3, PERFuRMANCE BOND.
WHEREAS, Palm Springs Disposal Services--is under contract with the City

of Palm Springs to provide trash pickup and disposal and related services
pursuant to Agreement No. 3082 approved March 18, 1992; and
WHEREAS, Section 8.2 of that agreement allows annual increases in the
rates based on the increase in the Consumer Price Index for Los
Angeles/Anaheim/Riverside for the twelve month period ending the preceding
June; and
WHEREAS, Palm Springs Disposal Services has requested a 3.0% increase
based on the increase in the C.P.I . , such increase to apply to rates
and charges noted in Exhibit A to Agreement No. 3082, except for the
portion of the rate attributable to the County dump fee, and excluding
the Single Family Dwelling Unit rate; and
WHEREAS, Section 8.2.2 of the Agreement requires City Council review
of any rate increase exceeding 3.0%; and
WHEREAS, City Council has determined that the requested rate increase
is justified.
WHEREAS, Section 12.3 of the Agreement, dealing with Performance Bonds,
needs to be amended to eliminate the requirements that the bond be
unconditional and remain in force during the entire term of the agreement.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm
Springs as follows:
Section 1. That based upon the foregoing, a 3.0% increase in all rates
and charges for trash pickup, disposal and related services,
excluding the County dump fee and Single Family Dwelling
Unit rate, is hereby approved, effective January 1, 1993.
Section 2. That Section 12.3, Performance Bond, be amended in part,
to delete the last sentence of the section and to substitute
therefor the following: "Said bond may not be cancelled
without providing 30 days cancellation notice by registered
mail to the City but contractor shall promptly provide a
replacement bond so there is no lapse in coverage. It is
further agreed that the Principal and Surety may continue ,
the aforementioned bond from year to year by continuation
certificate."
