HomeMy WebLinkAbout17950 - RESOLUTIONS - 9/16/1992 RESOLUTION NO. 17950 , OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,, CALI:FORNIA, AMENDING POLICY RELATIVE TO RESTRICTING STREE,ET WORK ON MAJOR AND SECONDARY THOROUGH- FARES WHEREAS, the City Council by Resolution No. 17760 has established policy relative to restricting street work on major and secondary thoroughfares during winter season months; and WHEREAS, major construction, excavation, maintenance and street work interferes with tourist and local vehicle traffic; and WHEREAS, traffic on major and secondary 'thoroughfares is greater during the prime winter season months; and A WHEREAS, a comprehensive policy is needed to regulate work to the non-prime season months to lessen interference with vehicle and pedestrian traffic; and WHEREAS the City Council has recommended a uniform policy. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Springs, California, that the following policy shall regulate the issuance of permits for construction work on major and secondary thoroughfares and pedestrian areas adjacent thereto so that, whenever possible, construction work will be! done during the non-prime season months, defined as follows: 1) Non-emergency work shall include work on City streets, such as performing construction, trenching, reconstructing, installing, replacing, overlaying, sealing, etc. , of a non-safety, nor :Life-threatening nature, which is administered by the City of Palm Springs, or done by private developers, Caltrans (except Caltrans work on the State highway syst:em) , Riverside County, utility companies, and any body over which the City of Palm Springs has permitting authority. 2) Non-emergency street related maintenance or construction work is permitted on major or secondary 'thoroughfares in the City of Palm Springs during the prime season months from January 1 through Memorial Day when one-half of the street vehicular travel area remains open for traffic. A minimum of five (5) working days notice shall be: given by posting the work area and advertisement in the Public Notice section of the local press. 3) Non-emergency street related maintenance.e or construction work shall not be permitted from November 15 through Memorial Day in the following areas: (a) The central business district area bounded by Ramon Road, Calle Encilia, Granvia Valmonte, Belardo Road and Museum Drive (b) Tahguitz Canyon Way (c) Ramon Road (d) Palm Canyon Derive (e) Indian Canyon Drive C7 Res. No. 17950 Page 2 w 4) Non-emergency work shall not be permitted on any street area immediately adjacent to a special event from the day prior to the event through 'the day after the special event throughout the year. A special event is as defined in the City Of Palm Springs Special Events Calendar, published by the Recreation Division. 5) Notwithstanding the foregoing, emergency street construction may be performed wherever needed, as determined by the Director of Public Works. 6) Exceptions to this policy will be reviewed and approved or denied by the Director of Public Works. The decision of the Director of Public Works may be appealed to the City Manager. The decision of the City Manager shall be final. This policy does not apply where emergencies ` and/or public health, welfare and safety become overriding factors.
