HomeMy WebLinkAbout17936 - RESOLUTIONS - 9/2/1992 i RESOLUTION NO. 17936 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, APPROVING WIND TURBINE HEIGHT IN EXCESS OF 150 FEET PURSUANT TO SETTLEMENT AGREEMENT BETWEEN CITY OF PALM SPRINGS AND VIERAM TRUST. WHEREAS, VieRam Trust has submitted to the Bureau of Land Management (BLM) amended Plan of. Operations to operate the Cabazon Wind Park; and WHEREAS, in 1985 the City Council of the City of Palm Springs entered into a binding Settlement Agreement with Transworld Wind Corporation and International Dynergy, Incorporated, to achieve a full and complete settlement between parties regarding the Cabazon Wind Park and that the Settlement Agreement is binding upon all successors, grantees, subleases, assigns, heirs and personal representatives; and Y WHEREAS, the BLM has assigned Right-of-Way Grant, Serial No. CA- ' 13198 to VieRam Trust; and WHEREAS, VieRam Trust has requested City Council approval of a waiver of Section 1(e) of the Settlement Agreement which requires City Council approval of wind turbine height over 150 feet in height; and r WHEREAS, the BLM has completed an environmental assessment of the proposed modification in accordance with the Settlement Agreement; and WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented in connection with the hearing on the Project, including but not limited to the staff report, Settlement Agreement and all written and oral testimony. • NOW, THEREFORE, BE IT RESOLVED that based upon the foregoing the requested wind turbine height modification from 150 feet to 202 feet (total turbine height) is hereby approved subject to the conditions as follows: " 1. That all wind turbine generators shall be setback 1/3 mile from Interstate 10. 2 . That wind turbine height shall not exceed 202 feet in total height (tower and blade at maximum extension) . 3 . That staff is directed to prepare all necessary modifications to the Settlement Agreement as outlined in the staff report except that the provisions of the Settlement Agreement dealing with inoperative turbine removal and manufacturing warranties will not be deleted from the Settle Agreement.
