RESOLUTION NO. 17907 I
OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, OVERRULING THE PLANNING
COMMISSION DETERMINATION 10.397 THAT SWAP
MEETS ARE PROHIBITED IN THE M-1 ZONE.
WHEREAS the City has received a request by Dr. Anthony Salvaggio to
locate a swap meet at the site of the former Palm Springs Drive-in
Theatre, Ramon and Crossley Roads, M-1 Zone; and
WHEREAS the Planning Commission considered the request at a duly
noticed public meeting held on June 10, 1992; and
WHEREAS the Planning Commission determined that swap meets are ,I
prohibited in the M-1 Zone; and
WHEREAS the City Council held a duly noticed public meeting ion July w
15, 1992, on said request; and
WHEREAS the City Council reviewed all evidence provided at the
meeting including the staff report dated July 15, 1992, and all
other written and oral testimony.

THE CITY COUNCIL HEREBY FINDS AS FOLLOWS:
Section 1. That the use is in keeping with other uses: which
require a Type II Conditional Use Permit.
Section 2 . That field investigations will be required to
disclose that the subject use and its operations
are compatible with the uses permitted in the zone
wherein the subject use will be located.
Section 3. That the subject use may not cause substantial
injury to the values of property in the zone within
which the subject may be located if properly
conditioned by the Conditional Use Permit.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Y
Palm Springs, California, does hereby overrule the Planning
Commission determination and does hereby determine that a swap meet
is a permitted use in all appropriate zones but a Type II
Conditional Use Permit must be approved and issued in accordance
with all applicable procedures before building permits may be '
issued. A
