OF THE CITY COU14CIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING TENTATIVE TRACT ' MAP 27388 FOR AN ADDITIONAL FORTY LOTS IN THE SUNRISE NORTE DEVELOPMENT LOCATED ON SUNRISE WAY NORTH OF SAN RAFAEL DRIVE, 0-5 ZONE, SECTION 35. WHEREAS the City has received an application by Coachella 'Valley Housing Coalition for a tentative tract map for an additional 40 lots in the Sunrise Norte Development located on Sunrise Way north of San Rafael Drive (the Project) ; and WHEREAS the Planning Commission considered the Project at a duly ' noticed public hearing held on February 25, 1992; and WHEREAS the Planning Commission recommended approval with conditions as outlined in its Resolution No. 4187;; and WHEREAS the City Council has reviewed all evidence provided at the ` hearing including the staff report dated April 15, 1992, and all other written and oral testimony, and find the Pro„ject, subject to 'the conditions contained herein consistent with the requirements of the ordinances of the City and with State law. NOW THEREFORE BE IT RESOLVED that: the City Council of the City of :Palm, Springs, California, after considering the evidence provided ; at the hearing does hereby approve Tentative Tract Map 27388 for property hereinabove described in accordance with the following findings and subject to the following conditions: SECTION 1. The City Council finds: a. That the forty lot subdivision is consistent with the existing ' General Plan land use plan and. policies. + b. That the project is consistent with the proposed draft General Plan text on file with the State of California Office of Planning and Research (OPR) and there is a reasonable probability that it will be consistent with the revised ' general plan when adopted in that the project is consistent with the overall density and land use character of the General Plan which allows for single. family residential uses in this area. C. That there is little or no probability the project will be + detrimental to or interfere with the future adopted General Plan if the project is ultimately inconsistent with that plan. If a lower or higher intensity of development is adopted, the project would probably not be detrimental to the plan. d. That the 7.74 acre site :is adequate in size and configuration to accommodate the proposed forty lot subdivision and complies with all property development standards. e. That the proposed forty lot single family residential subdivision applied for under a tentative tract map application at the location set forth in the: application is properly authorized by local, and State law. lY Res. No. 17898 Cf�� • Page 2 f. That the site is located on Sunrise Way which is adequate in size to accommodate the quantity of traffic anticipated by the proposed subdivision. g. That this project was previously assessed under Case 5.0144- PD-115 and the General Plana TTnendnan.t completed with thEt " case. A Negative Declaration with mitigation measures was filed in accordance with local and State law. h. That the proposed project with streets less than 40 feet in width is the extension of an existing subdivision, the new roadway section is limited to local circulation, and will not adversely affect public health, safety and .welfare. SECTION 2 . The Project is approved subject to the following conditions; all of which are to be satisfied prior to approval of the final tract map: a. That all Development Committee conditions dated February 26, 1992, shall be met. a b. That all mitigation measures of the environmental assessment • for Case 5.0144-PD-116 shall be met. C. The final development plans shall be submitted in accordance with Section 9403.00 of the Zoning Ordinance. Final development plans shall include site plans, building elevations, floor plans, roof plans, grading plans, landscape plans, irrigation plans, exterior lighting plans, sign program, mitigation monitoring program, site cross sections, property development standards and other such documents as required by the Planning Commission. -� d. That the 101 pedestrian easement proposed between Lots 5 and 6 be removed. ADOPTED this 1st day of July , 1992 .
