HomeMy WebLinkAbout17891 - RESOLUTIONS - 6/17/1992 RESOLUTION NO. 17891 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, SETTING TIME AND PLACE FOR PUBLIC HEARINGS ON NECESSITY TO ORDER ACQUISITION BY EMINENT DOMAIN PROCEEDINGS WHEREAS, the City of Palm Springs has been investigating the acquisition of certain lands needed for the McCallum Desert Preserve and Equestrian Center,recreation facilities, open space and public purposes consisting of installation of access and parking improvements and enhancement of Coachella Valley desert wash habitat; and WHEREAS, despite negotiations with property owners, and attempts by the City at voluntary transfers of the property, the City has not been able to reach terms of agreement with the landowners. WHEREAS, at this time the City is desirous of setting a time and place for a public hearing on a resolution of necessity to determine whether eminent domain is necessary to acquire the needed land not yet acquired for the said project. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs as follows: Section 1. That the above citations are all true and correct. Section 2. That the properties for which a resolution of necessity is needed are described in Exhibit "A" and shown on the map attached hereto and made a part hereof. Section 3. That notice is hereby given that on Wednesday, July 1, 1992, at the hour of 7:30 p.m. in the City Council Chambers at 3200 Tahquitz Canyon Way, Palm Springs, any and all persons whose land is to be acquired will have an opportunity to appear and be heard on the matter of the necessity to exercise the right of eminent domain to acquire land necessary for the McCallum Desert Preserve and Equestrian Center, recreation facilities, open space and public purposes. All persons objecting to the public interest and necessity for the project and the determination as to whether or not the project is planned and/or located in a manner which will be most compatible with the greatest public good and the necessity for the property to be acquired should be present at said time and place if they wish to be heard pursuant to Sections 1245.235 of the Code of Civil Procedure. Section 4. Staff is hereby directed to notice the property owners concerning adoption of the Resolution of Necessity as required by code of civil procedure, Sections 1240.030 and 1245.235, and provide other public notice as required or permitted by law.
