HomeMy WebLinkAbout17835 - RESOLUTIONS - 5/6/1992 RESOLUTION NO. 17835 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA OVERRULING THE PLANNING COMMISSION ACTION TO DENY AN APPEAL BY CHARLES LINDSEY TO GRANT A 12 MONTH TIME EXTENSION FOR CASE 3.0698 FOR A 35 UNIT APARTMENT COMPLEX LOCATED AT 2201 SOUTH PALM CANYON DRIVE, R-2 ZONE, SECTION 27 WHEREAS the City has received an application by Charles Lindsey for a 12 month time extension for a 35 unit apartment complex located at 2201 South Palm Canyon (the Project) ; and ' WHEREAS the Planning Commission considered the project at a duly noticed public meeting held on March 11, 1992 ; and WHEREAS the Planning Commission recommended denial of the request y as outlined in its Resolution No. 4179; and WHEREAS the City Council held a duly noticed public meeting on April 15, 1992, on said project; and WHEREAS the City Council has reviewed all evidence provided at the meeting including the staff report dated April 15, 1992, and all other written and oral testimony and finds the Project, subject to the original conditions consistent with the requirements of the ordinances of the City and with State law. ' NOW THEREFORE the City Council hereby finds as follows: 1. Any future down zoning of the property through the General Plan process is speculative. i 2. Single family housing on the property may not be appropriate due to surrounding land uses and conditions which include multiple family dwellings and topographic conditions and fast moving traffic on South Palm Canyon Drive. 3 . Due to general recessionary economic conditions, financing has been difficult to obtain and the applicant has demonstrated good cause for his loss of financing and failure to timely obtain permits. 4. It would be inequitable to not let the applicant proceed with a project in which he has complied with all procedures and requirements of the City. 5. The City has generally granted such extensions in the past. BE IT RESOLVED that the City Council of the City of Palm Springs, California, does hereby overrule the Planning Commission denial and ' does hereby approve a 12 month time extension to January 24, 1993 for Case 3 .0698 for a 35 unit apartment complex located at 2201 South Palm Canyon Drive subject to the original conditions. ADOPTED this 6th day of May , 1992 .
