' RESOLUTION NO. 17829
OF THE CITY COUNCIL OF THE CITY OF PALM
" SPRINGS, CALIFORNIA, APPROVING REVISED
PRELIMINARY PLANNED DEVELOPMENT DISTRICT (PD-
205) FOR A RETAIL CENTER LOCATED ON THE
" NORTHWEST CORNER OF SUNRISE WAY/TAHQUITZ
CANYON WAY, C-1-AA AND R-4-VP ZONES (IL) ,
SECTION 14
WHEREAS, Benco Development, (the "Applicant") has requested
approval for a revision to Case 5. 0522-PD-205 for a Planned
Development District for a retail center (the Project) , located on
' the northwest corner of Sunrise Way/Tahquitz Canyon Way, C-1-AA and
R-4-VP Zones (IL) , Section 14 ; and
WHEREAS, the Planning Commission considered the Project at a duly
notice meeting held on March 25, 1992 ; and
WHEREAS, the Planning Commission recommended approval with
i conditions as outlined in its Resolution No. 4183 ; and
WHEREAS, the City Council held a duly noticed meeting on April 15,
1992 ; and
WHEREAS, the City Council has reviewed all evidence provided at the
hearing including the staff report dated April 15, 1992 and all
other written and oral testimony, and finds the Project, subject to
the conditions contained herein consistent with the requirements of
the ordinances of the City and with State law.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of
Palm Springs, California, after considering the evidence provided
at the hearing does hereby approve the revised preliminary Planned
Development District for property hereinabove described in
accordance with the following findings and subject to the following
conditions:
SECTION 1. The City Council finds:
a. That the proposed retail center is consistent with existing
General Plan land use plan and policies.
b. That the project is consistent with the proposed draft General
Plan text on file with the State of California Office of
Planning and Research (OPR) and there is a reasonable
probability that it will be consistent with the revised
general plan when adopted in that the project is consistent
with the overall density and land use character of the General
" Plan which allows for resort commercial and neighborhood
convenience center uses in this area .
c. That there is little or no probability the project will be
detrimental to or interfere with the future adopted General
Plan if the project is ultimately inconsistent with that plan.
If a lower or higher intensity of development is adopted, the
project would probably not be detrimental to the plan.
d. That the use applied for is necessary or desirable for the
development of the community, is in harmony with the various
elements or objectives of the General Plan, and is not
detrimental to existing uses or to future uses specifically
permitted in the zone in which the proposed use is to be
located.
e. That the 3 . 7 acre site is adequate in size and configuration
to accommodate the proposed retail center.

f. That the proposed retail center applied for under a planned
development district application at the location set forth in
the application is properly authorized by local and State law.
g. That the site is located on Sunrise Way, `1'ahquitz Canyon Way
and Andreas Road which are adequate in size to accommodate the
quantity of traffic anticipated by the proposed project.
h. That an environmental assessment was completed with the
initial planned development district and a Negative
Declaration was filed in accordance with local and State law. '

i. That the conditions to be imposed and shown on the approved
site plan are deemed necessary to protect the public health,
safety and general welfare, including any minor modifications
of the zone's property development standards.
SECTION 2 . The Project is approved subject to the following I
conditions; all of which are to be satisfied prior to issuance of
certificate of occupancy unless otherwise specified:
a. That the Development Committee conditions dated September 27 , '
1989 be met.
b. That all conditions placed on the project: with the original
approval on November 1 , 1989 shall be met.
C. That a median island be required including design, funding and 1
maintenance, with final details to be resolved to the
satisfaction of the Director of Planning & Zoning prior to
approval of final development plans. The City and applicant
shall share the cost of- the median island, and the applicant
shall provide all landscape and irrigation.
d. That the Taco Bell drive-through structure: have a barrel roof
with the arch lowered and thickened as approved by the
Director of Planning & Zoning.
e. That the window behind the arch be lowered as approved by the
Director of Planning & Zoning.
