OF THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA, APPROVING
THE ACQUISITION OF RIGHT-OF-WAY FOR
CAPITAL IMPROVEMENT PROJECT NO. 89-05
EL CIELO ROAD WIDENING PROJECT IN
SECTION 19.

WHEREAS a strip of land having a frontage of 200 feet along El Cielo Road and 44 feet in
width north of Mesquite Avenue in Section 19, more particularly described in Exhibit "A"
attached hereto, is needed for the El Cielo Road widening project; and
' WHEREAS the owner's, Albert T. and Betty R. Sommerfield, have agreed to sell the right-of-
way needed land to the City for the sum of $22,000.00 dollars ;and
WHEREAS based on the opinion of a licensed appraiser, $22,000.00 dollars is the fair market
value for the needed land; and
WHEREAS acquisition of the strip of right-of-way described in Exhibit "A" attached hereto will
permit El Cielo Road to be widened between Sunny Dunes Road and Mesquite Avenue and will
improve the flow of traffic and control of storm water drainage.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs,
California, as follows:

Section I. That the acquisition of the right-of-way described in Exhibit "A" attached
hereto is hereby approved.
• Section 2. That the City Manager and City Clerk are hereby authorized to sign all
documents, approved by the City Attorney as to form, on behalf of the
City of Palm Springs, necessary to consummate the acquisition of the
right-of-way described in Exhibit "A" attached hereto.
Section 3. That the City Clerk is hereby authorized to accept the Grant of Right-of-
Way and arrange for it to be recorded in the County Recorder's Office on
behalf of the City of Palm Springs.
ADOPTED this 1st day of April 1992.
