HomeMy WebLinkAbout17815 - RESOLUTIONS - 4/1/1992 J RESOLUTION NO. 17815 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT TO ALLOW THE CHANGE IN USE FROM A HOTEL TO AN PRIVATE ADULT EDUCATIONAL INSTITUTION FOR THE PROPERTY LOCATED AT 1983 NORTH PALM CANYON DRIVE, R-3 ZONE, SECTION 3 . (CASE 5. 0603-CUP) WHEREAS the City has received a request to change the existing use of a hotel into an private adult educational institution by Mr. . Chandra and Mr. Khatri; and WHEREAS the Planning Commission considered the project at a duly r noticed public hearing held on March 11, 1992 ; and WHEREAS the Planning Commission recommended approval as outlined in its Resolution No. 4180; and WHEREAS the City Council held a duly noticed public hearing on April 1, 1992, on said project; and r WHEREAS the City Council has reviewed all evidence provided at the � hearing including the staff .report dated March 11, 1992 , and all other written and oral testimony, and finds the Project consistent with the requirements of the ordinances of the City and with State law. NOW THEREFORE BE IT RESOLVED that the City Council of the City of Palm Springs, California, after considering the evidence provided at the hearing does hereby approve the conditional use permit in accordance with the following findings: SECTION 1. The City Council finds: a. That the change in use from a hotel to an adult educational institution is consistent with the existing General Plan land use plan and policies. b. That the project is consistent with the proposed draft General y Plan text on file with the State of California Office of Planning and Research (OPR) and there is a reasonable probability that it will be consistent with the revised General Plan when adopted in that the project is consistent with the overall density and land use character of the proposed General Plan. C. That there is little or no probability the project will be detrimental to or interfere with the future adopted General Plan. If a lower or higher intensity of development is Y adopted, the project would probably not be detrimental to the plan. d. That the use applied for is desirable for the development of , the community, in that it provides additional education ' facilities for the community and will not !be detrimental to existing uses or uses specifically permitted in the zone which the proposed use is to be located. R17815 Page 2 e. That the site is adequate in size and shape to accommodate the uses and all on-site improvements, i.e.p yards, walls or fences, landscaping, and parking. f. That the site is serviced by Palm Canyon Drive, a major thoroughfare, which has been designated to carry the quantity of traffic generated by the development. SECTION 2 . That the project is approved subject to the following conditions; all of which are to be satisfied prior to issuance of certificate of occupancy unless otherwise specified: a. That an exterior lighting plan shall be submitted for approval by the Director of Planning and Zoning and all existing illegal lights shall be removed. The lighting plan shall be t submitted to the Director of Planning and Zoning for approval within 60 days subsequent to City Council approval and shall conform to Section 9306.00.C.4 . of the Zoning Ordinance. Installation and completion of the parking lot lighting shall be done prior to issuance of Certificate of Occupancy. b. That the parking lot shall be re-striped per City of Palm Springs Standards. A parking plan shall be submitted to the ' Director of Planning and Zoning for approval and shall be a completed prior to issuance of Certificate of Occupancy. C. That the occupancy of the school shall be limited to 200 students with the option that the property may be used as a hotel during the periods that the school is not operating at full capacity. students shall be a minimum of 18 years of age. d. A sign program that complies to Section 9320 . 00 of the Zoning Ordinance shall be developed for this project. The sign program shall be submitted for Planning Commission approval and will remain in effect for the duration of the Conditional Use Permit as stated below. e. The private school may continue to operate for a period of fifteen (15) years without further city review provided all conditions contained herein are complied with and at the end of 15 years the Conditional Use Permit may be extended by the City after review by the Planning Commission at a public hearing. Any complaints received by the City shall be reviewed by the Director of Planning and Zoning and if ` substantive concerns are raised, the Director shall submit complaints to the Planning Commission. Any proceedings regarding the revocation of this permit shall be in acccordance with the Zoning ordinance provisions in effect at the time of such proceedings. .1 R17815 Page 3 + f. Students or guests staying 28 days or less shall be subject to the City's Transient Occupancy Tax (TOT) . The taxable rental shall be the greater of: a. $25. 00 per day, or b. 25% of the amount: they, paid. The TOT rate (currently 10%) shall be applied on the amount calculated under (a) or (b) above.
