OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, OVERRULING THE PLANNING
" COMMISSION AND APPROVING AN APPEAL BY THE PALM
SPRINGS CONVENTION CENTER TO ALLOW A PHASED
INSTALLATION OF A PERMANENT PARKING FACILITY
ON THE NORTHWEST CORNER OF AMADO ROAD/AVENIDA
CABALLEROS, R-4 ZONE, SECTION 14 .
WHEREAS the City Council of the City of Palm Springs has considered
an appeal on behalf of the Palm Springs Convention Center seeking
relief from the Planning Commission condition of approval of Case
5. 0595-CUP to delete the proposed phased installation of a
permanent parking facility on the northwest corner of Amado
Road/Avenida Caballeros and require all improvements to be
installed at one time; and
WHEREAS the City Council is in agreement with the appeal by the
Palm Springs Convention Center for the property hereinabove
described.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of
Palm Springs, California, does hereby approve the appeal by the
Palm Springs Convention Center to allow phased construction of the
proposed parking facility on the northwest corner of Amado
Road/Avenida Caballeros based on the following findings and subject
to the following conditions:
SECTION 1. The City Council finds:
a. That the construction of the parking lot for approximately 240
vehicles in conjunction with the Convention Center is
consistent with existing General Plan land use plan and
policies.
b. That the project is consistent with the proposed draft General
Plan text on file with the State of California Office of
Planning and Research (OPR) and there is a reasonable
probability that it will be consistent with the revised
general plan when adopted in that the project is consistent
with the overall density and land use character of the General
Plan which allows for high density residential uses within
this area.
C. That there is little or no probability the project will be
detrimental to or interfere with the future adopted General
Plan. If a lower or higher intensity of development is
adopted, the project would probably not be detrimental to the
plan.
C. That the site containing approximately 2 . 45 acres is adequate
in size and configuration to accommodate the proposed parking
lot and complies with all property development standards.
e. That the proposed parking lot facility applied for under a
conditional use permit at the location set forth is properly
authorized by local and State laws.

f. That the site is located on Avenida Caballeros and Amado Road
which are adequate in size to accommodate the quantity of
traffic anticipated by the proposed project,.
g. That an environmental assessment has been completed and that
a mitigated Negative Declaration of environmental impact will
be filed in accordance with local and State laws.,
SECTION 2 . The construction of the parking lot shall be
subject to the following conditions:
a. That the parking Facility be phased as follows:
Phase I. (To be completed within 6 months)
Install conduit for future electric and water services.
Expand, pave and stripe parking lot.
Install an upgraded sidewalk along Avenida Caballeros.
Build-up berming around perimeter of parking lot,.
Install perimeter landscaping materials (matching existing
Convention Center landscaping) . '
Phase II. (To be completed within 12 months)
Install concrete curb and gutter.
Complete required roadway improvements.
Phase III . (To be completed within 18 months)
Install interior islands and landscaping materials.
Install interior lighting ]Fixtures.
If funding becomes available permitting the acceleration of
the foregoing scheduleā the Convention Center shall accelerate
said schedule to the extent, feasible.
b. That the proposed development of the premises shall conform to
all applicable regulations of the Palm Springs Municipal Codes
or any other city codes, ordinances and resolution which
supplement the Zoning district regulations.
C. That final landscape, irrigation, and lighting plans shall be
submitted for approval 'to the Department of Planning & Zoning
prior to construction. Landscape plans shall be approved by
the Riverside County Agricultural Commissioner's Office prior
to submittal. -
d. Pursuant to Fish & Game Code Section 711. 4 a fi.linq fee of
$25 . 00 is required, this project has a deminimus impact on
fish and wildlife and a Certificate of Fee Exemption shall be
completed by the City and two copies filed with the County
Clerk. This application shall not be final until such fee is
paid and a fee exemption is filed.
e. That all lighting shall be :reviewed in detail by the :Planning
Commission and may be modified because of impacts on
residential property to the: north.

f. That access to the property shall be prohibited when not in
use for convention Center functions with entrances to be
gated; that access to Avenida Caballeros shall be utilized as
an exit only and remain gated until an event is over and the
access opened only to clear the parking lot.
g. That the Risk Manager for the City of Palm Springs shall
review the plans prior to construction and may recommend
changes to reduce the city's liability.
h. That alternatives to the proposed planting materials shall be
reviewed with the architectural design review committee prior
to construction.
i. That the tree wells shall be 6 feet by 6 feet.
j . That canopy trees shall be included in the landscape along
Caballeros and Amado.
