OF THE CITY COU14CIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, AMENDING THE EMPLOYER-EMPLOYEE
RELATIONS RESOLUTION, NO.16438 '
WHEREAS, Resolution 16438, the Employer-Employee Relations Resolution of the City of Palm Springs,was adopted April
6, 1988,and
WHEREAS, the City has the exclusive right to establish additional or different employee units of representation by action of
the City Council as it deems appropriate, upon the City's own motion or upon a petition filed by an employee organization
pursuant to Section 9 of Resolution 16438, and
WHEREAS, in making its unit determination,the City Council has investigated and considened whether and which employees
share a similar community of interests,the City's needs to maintain an efficient operation,the emits of representation historically
recognized by the City, and other matters considered relevant by the City to promoting sound employer-employee relations and
efficient operation of the City; and
WHEREAS the Municipal Employees Relations Re resentative(MERR)has received petitions for recognition of an employee
organization from the Palm Springs Fire Management Association and the Palm Springs Professional and Management
Association;
NOW, THEREFORE,, THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS
FOLLOWS:

Section 1. Section 8.1 of Resolution 16439 is amended to read as follows:

118.1 The City has investigated and considered the services performed by its employees,their working conditions,
and job duties and the City's needs to maintain an efficient operation while providing sound employer-
employee relations and the units of representation historically recognized by the City. The City has
concluded, based upon these investigations and considerations, that it is most conducive to harmonious
employer-employee relations and to efficient operation of the City and that it is therefore proper and
reasonable to define the following six (6) separate employee units of representation, subject to Section 4.4
herein:

Section 8.l.1 Fire Safety Unit consisting of all firefighting and fire inspection employees in the Fire Department
below the rank of Fire Captain.
Section 8.1.2 Fire Management Unit consisting of all management,professional and supervisory positions in the
Fire Department,but no safety positions below the rank of Fire Captain. `
Section 8.1.3 Police Safety Unit consisting of employees in the Police Department who are sworn police officers
below the rank of Police Lieutenant.
Section 8.1.4 Police Management Unit consisting of all management,professional and supervisory positions in
the Police Department,but no sworn positions below the rank of Police Lieutenant. y
Section 8.1.5 General Unit consisting of all other employees except executive, management, professional and
supervisory positions that are miscellaneous positions under the California State Retirement System.
Section 8.1.6 Management Unit consisting of all management,professionaland supervisory positions lhatare not
in the Police or Fire Departments."

Section 2. Section 3.4 of Resolution 16433 is amended to read as follows:
"3.4 A 'Confidential Employee' means any person employed by the City who assists or acts in a confidential
capacity to a person who formulates, determines or effectuates management policy in employer-employee
relations."

Section 3. Add Section 3.17 to Resolution 16438 as follows:
"3.17 'Executive Employee' means any employee employed in a position that is allocated to an executive
compensation plan and serves al.the City Manager's will and pleasure." t
Section 4. Except as expressly amended above in Sections 1 and 2, all other provisions of Resolution 16438 shall remain as
provided herein.
