HomeMy WebLinkAbout17787 - RESOLUTIONS - 2/5/1992 RESOLUTION NO. 17787 ' OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING THE ACQUISITION OF PROPERTY FOR ASSESSMENT DISTRICT NO. 157 IN SECTION 19. WHEREAS the City Council of the City of Palm Springs, California, has previously adopted its Resolution of intention pursuant to the provisions of the "Municipal Improvement Act of 1913", being Division 12 of the Streets and Highways Code of the State of California, for the construction of certain public improvements, together with appurtenances and acquisition, where necessary, in a special assessment district known and designated as ASSESSMENT DISTRICT NO. 157 (hereinafter referred to as the "Assessment District"); and WHEREAS in order to accomplish construction of the works of improvement in the Assessment District, it is necessary to acquire certain property, being more particularly described in Exhibit " "A" attached hereto, for construction purposes; and WHEREAS the City has established the amounts which it believes to be the just compensation i for the property sought to be acquired; and WHEREAS pursuant to Government Code §7267.2, the City has offered to the owners of the real property, or interests therein, full amount established as just compensation for the property sought to be acquired; and WHEREAS the owners of the real property have accepted the offer presented by the City and agreed to grant the property needed to construct the Assessment District improvements. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs, California, as follows: " Section 1. That the acquisition of property described in Exhibit "A" attached hereto is hereby approved. Section 2. That the City Manager and City Clerk are hereby authorized to sign all documents on behalf of the City of Palm Springs, necessary to consummate the acquisition of the property described in Exhibit "A" attached hereto. Section 3. That the City Clerk is hereby authorized to accept the Deeds and arrange for the Deeds to be recorded in the County Recorders Office on behalf of the City of Palm Springs.
