OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, CERTIFYING NEGATIVE
DECLARATIONS AND ADOPTION OF FINAL DRAFT
ELEMENTS TO MEET MANDATED IMPLEMENTATION
OF AB939- THE CALIFORNIA. INTEGRATED WASTE
MANAGEMENT ACT.

WHEREAS pursuant to the September, 1989 California Integrated Waste
Management Act (Assembly Bill {AB} 939) and its companion bill, AB
2707 , each California county and incorporated City must prepare a
Source Reduction and Recycling Element (SRRE) that demonstrates how
they will meet the State's solid waste diversion goals of 25
percent by the year 1995 and 50 percent by the year 2000, and a
-,. Household Hazardous Waste Element (HWWE) that identifies a program
for the safe collection, recycling, treatment and disposal of
hazardous wastes; and
' WHEREAS the City of Palm Springs has agreed to allow the Coachella
Valley Association of Governments (CVAG) tp act as their agent in
preparing of these elements and required California Environmental
Quality Act documentation; and
WHEREAS the CVAG Executive Committee is composed of representatives
from ten member jurisdictions: Cathedral City, Coachella, Desert
Hot Springs, Indian Wells, Indio, La Quinta, Palm Desert, Palm
Springs, Rancho Mirage and the County of Riverside; and
WHEREAS in adopting a unified and coordinated approach to address
Coachella Valley's solid and hazardous waste management needs and
the requirements of AB 939 and AB 2707, CVAG has prepared one
regional SRRE and one regional HHWE. The regional SRRE and HHWE
includes specific objective and funding plans tailored to the
existing conditions and needs of each of the nine CVAG incorporated
Cities; and
WHEREAS in order to streamline the environmental review process and
prevent preparation of nine separate Negative Declarations for both
the SRRE and HHWE, and pursuant to Section 15051 of the California
Environmental Quality Act guidelines, CVAG was designated as Lead
Agency on behalf of the nine CVAG Cities at the June 3 , 1991
Executive Committee meeting for the purposes of preparing and
approving one Negative Declaration for the SRRE and one Negative
Declaration for the HHWE.
WHEREAS as a public hearing was held on these elements by the Palm
Springs City Council on January 22 , 1991; and
WHEREAS the CVAG environmental assessment identified potentially
significant impacts including air, earth, water, plant and animal
life, noise, land use, natural resources, housing, transportation,
human health, energy, utilities and public services, and found that
the potentially significant impacts will be reduced to a level of
insignificance by implementation of mitigation measures; and
WHEREAS mitigation monitoring programs are incorporated into the
Source Reduction and Recycling and Household Hazardous Waste
Elements and that local and state entities are involved in the
mitigation monitoring; and
WHEREAS an initial study and testimony received at said hearing has
determined that the project, defined as these elements and their
adoption, would not have a significant adverse impact on the
environment due to mitigation measures contained therein; and

WHEREAS on or about January 27, 1992 , the CVAG Executive Committee
adopted one negative declaration for the CVAG SRRE and one 'I
negative declaration for the CVAG HHWE;
NOW THEREFORE, BE IT RESOLVED by the City council. of 'the City of
Palm Springs, California as follows:
to The City Council certifies it has reviewed and considered
information contained in the mitigated negative declaration
prepared by CVAG, the lead agency for the project, prior to
approving the project and has determined therefore that the project
will not have a substantial impact on the environment and adopts
the mitigated declaration.
2 . The City adopts the Final Drafts of the Source Reduction and
Recyc:Ling and Household Hazardous Waste Elements pursuant -to the
1989 California Integrated Waste Management Act (AB 939) and its
companion bill AB 2707 .
