RESOLUTION NO. 17767 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING THE ACQUISITION OF 2 LOTS IN AN AREA SOUTH OF MESQUITE, EAST OF EL CIELO, NORTI I OF TAI-IQUITZ CREEK IN SECTION 19. WHEREAS the property owner of 2 lots located in an area south of Mesquite Avenue, East of El Cielo Road, North of Tahquitz Creek and described in Exhibits A & B attached hereto, has agreed to sell the subject lots to the City for the sum of $10,000.00; and r WHEREAS based on the opinion of a licensed appraiser, $9,000.00 is the fair market value for the subject lots and the additional $1,000.00 is justified based on the higher cost of further negotiation and/or legal action; and WHEREAS the highest and best use for the lots is for public purposes, recreational Purposes and open space because the lots cannot be developed now nor in the future because the lots are located in a 100 year flood plain elevation and there are no existing road improvements and/or public utilities to the lots. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs as follows: Section 1. That the acquisition of the 2 lots described in Exhibits A & B is hereby approved. Section 2. That the City Manager and City Clerk are hereby authorized to sign all documents on behalf of the City of Palm Springs necessary to consummate the acquisition of the 2 lots located South of Mesquite Avenue, East of Cielo Road and North of Tahquitz Creek described in Exhibits A & B attached to the report of the Director of Public Works dated January 8, 1992; and, on file with the City Clerk, for the total purchase price of $10,000.00 plus title and escrow fees. Section 3. That the City Clerk is hereby authorized to accept the deeds and record them in the County Recorder's office on behalf of the City of Palm Springs. Adopted this 8th day of January 1992.
