SPRINGS, CALIFORNIA, APPROVING ]REVISED
PRELIMINAHRY AND FINAL PLANNED DEVELOPMENT
DISTRICT APPLICATION 5 . 0004-PD-74-A TO ALLOW
THE CHANGE IN USE OF A BUILDING FROM A BANK TO
A RESTAURANT FOR THE PROPERTY LOCATED AT 190
N. SUNRISE WAY, C-1AA, P ZONE, SECTION 13 .

WHEREAS the City has received a request for a revised Planned
Development District Application by Mr. Hosea Brown to allow the
change is use of an existing bank building to a restaurant; and
WHEREAS the Planning commission considered the project at a duly
noticed public hearing held on December 11, 1991; and
WHEREAS the Planning Commission recommended approval as outlined in
its Resolution 4171; and
NOW THEREFORE BE IT RESOLVED that the City Council of the City of
Palm Springs, California, after considering the evidence provided
at the hearing does hereby approve revised Planned Development
District 74-A (Case 5 . 0004-PD-74-A) for property hereinabove
described in accordance with the following findings:
SECTION 1. The Planning Commission finds:
a. That the application for a restaurant use at, the; address
indicated above .is consistent with the existing General
Plan land use plan and policies.
b. That the project is consistent with the proposed draft
General Plan text on file with the State of California
Office of Planning and Research (OPR.) and there is a
reasonable probability that it will be consistent with
the revised General Plan when adopted in that the project
is consistent with the overall density and land use
character of the proposed General Plan.
C. That there is little or no probability the project will
be detrimental to or interfere with +the future adopted
General Plan. If a lower or higher :intensity of
development is adopted, the project would probably not be
detrimental to the plan.
d. That the use applied for is desirable for the development
of the community, in that a building that has been vacant
for a period of three to four years is being reopened and
will not be detrimental to existing uses or uses
specifically permitted in the zone which the proposed use
is to be located.
e. That the site is adequate in size and shape to
accommodate the uses and all of the yards, walls or
fences, landscaping, and other features required in order
to adjust said use 'to those existing or permitted future
uses on the subject property and in the neighborhood.
f . That the site is serviced by Sunrise Way, a major
thoroughfare, Andreas Road, a collector roadway, which
f has been designzd and improved to carry the quantity of
traffic generated by 'the development,
CONDITIONS: The project is approved subject to the following
' conditions; all of which have to be satisfied prior
to issuance of certificate of occupancy unless
otherwise specified:
a. All Development Committee conditions shall be complied with.
b. All mitigation measures of the Environmental Assessment shall
be complied with.
C. That the angled parking be restudied and that parallel parking
be used as an alternative.
d. That all broken light fixtures be replaced.

e. That Section 9306 . 00 of the Zoning Ordinance (Off-street
Parking) shall be complied with based on the proposed number
of seats. The applicant will be required to put together a
parking management plan which shall include and shall not be
` limited to valet parking, leasing parking spaces for night
time use or :reduce the number of seats shall be submitted to
the Director of Planning & Zoning prior to certificate of
k " occupancy.
f. That the landscape material in the planters along Sunrise Way
be installed and maintained at different heights.
9- That the new 51-011 walkway along Sunrise Way be deleted.
h. That employees be required to park on-site and that parallel
parking be designated as employee parking unless alternative
provisions are approved in the parking management program.
i. That any proposed mechanical equipment shall be completely
screened b`/ the roof structure per Section 9303 . 00 .B. of the
Zoning Ordinance. Plans shall be reviewed and approved prior
to issuance of permits.
j . That staff monitor the driveway on Sunrise Way, with the
option to re-evaluate the driveway if problems arise.
ADOPTED this 8th day of January 1992 .
