OF THE CITY OF PALM SPRINGS, CALIFORNIA, RECITING THE FACT OF THI CONSOLIDATED SPECIAL MUNICIPAL ELECTION HELD IN SAID CITY ON NOVEMBER 5, 1991 AND DECLARING THE RESULTS THEREOF AND SUCH OTHER MATTERS AS PROVIDED BY LAW. ' WHEREAS a Consolidated Special Municipal Election was held and conducted in the City of Palm Springs, California, on Tuesday, November 5, 1991; and WHEREAS notice of said election was duly and regularly given in time, form and manner as provided by law; that voting � l precincts were properly established; that election officers , were appointed and that in all respects said election was held and conducted and the votes cast thereat., received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California; and ' WHEREAS pursuant to Resolution 17609, adopted by the City Council on July 31, 1991, the Registrars Office of the County of Riverside canvassed the returns of said election and has certified the results to tha City Clerk, said results are received, attached and made a part hereof as "Exhibit A", HOU THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs, as follows: Section 1. That there were 18 voting precincts established for the purpose of holding said election consisting of consolidations of the regular election precincts in said City as established for the holding of State and County elections . Section 2. That said Consolidated Special Municipal Election was held for the purpose of submitting the following measures to the electors of said City; to wit: i MEASURE M :Shall an ordinance, which creates :a new special Tourism Paid Advertising Fund t :to exclusively fund paid advertising to promote :the City as a tourist and visitor destination, :and which shifts to the new Tourism Paid :Advertising Fund from the City' s General Fund :and one percent (1%) transient occupancy tax :collected by the City pursuant to Municipal , :Code Section 3. 24.036, be adopted? MEASURE N :Shall the Fire Suppression Benefit :Assessment, imposing an annual levy not to :exceed the following assessment schedule be :used to improve existing fire suppression :services, be adopted? :A) Category I - Residential (Single family :detached, condominium, mobile homes, time :shares) $38.40 to $64.00. :B) Category II - Vacant acreage $30.00 to :$60.00 :C) Category III - Commercial (industrial , :manufacturing, mercantile, multi-family :dwellings, etc. ) $128.00 to $640.00 Res. No. 17704 Page 2 l MEASURE 0 ADVISORY VOTE ONLY :Should the City Council support the development :of a Raceway and Related Facilities in an :area to be annexed to the City, generally :described as the property south of Interstate : 10, bounded by ;Indian Avenue on the west, :Southern Pacific Railroad on the south, and :Gene Autry Trail on the east? ` Section 3. That the whole number on votes cast in said City (except absent voters ballots) was 4,665. That the whole number of absent voter ballots cast in said city was 1,790, making a total • of 6,455 votes cast in said city. Section 4. That the measures voted upon at said election are as follows: r MEASURE M Shall an ordinance, which creates a new special Tourism Paid Advertising Fund to exclusively fund paid advertising to promote the City as a tourist and visitor destination, and which _ shifts to the new Tourism Paid Advertising Fund from the City's General Fund and one percent (1%) transient occupancy tax collected by the City pursuant to Municipal Code Section 3.24.036, be adopted? MEASURE 0 ADVISORY VOTE ONLY Should the City Council support the development of a Raceway and related Facilities in an area to be annexed to the City, generally described as the property south of Interstate 10, bounded 1 by Indian Avenue on the west, Southern Pacific Railroad on the south, and Gene Autry Trail on the east? That the number of votes given at each precinct ` and the number of votes given in the City for ' and against each measure were as listed in "Exhibit A" attached. Section 5. That as a result of said election, a majority of the qualified voters voting on Measure M relating to the Transient Occupancy Tax did vote in opposition thereof, and that said measure was defeated. That as a result of said election, a majority of the qualified voters voting on Measure N relating to the Fire Suppression Benefit Assessment did vote in opposition thereof, and that said measure was defeated. Res. No. 17704 Page 3 That as a result of said election, a majority of the qualified voters voting on Measure 0 relating to the Advisory Vote for the Raceway and other Related Facilities did vote in opposition thereof, and that said measure was defeated. , l Section 6. The City Clerk shall enter on the records of the City Council of said City, a. statement of the result of said election, showing: (1) The whole number of votes cast in the City; (2) The measures voted upon; . . (3) The number of votes given at each precinct for and against each measure; (4) The number of votes given in the City for and against each measure. Section 7. That the City Clerk shall certify to the passage and adoption of this Resolution; shall enter the same in the book of original resolutions of said City; and shall make a minute of passage and adoption thereof in the records of the proceedings of the City Council of said city, in the minutes of the meeting at which the ;same is passed and adopted. PASSED, APPROVED, AND ADOPTED this 4th day of December , 1991.
