OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, APPROVING CASE 5. 0596-PD-
223/TTM 27208 FOR 64 SINGLE FAMILY RESIDENTIAL
LOTS LOCATED ON AVENIDA CABALLEROS BETWEEN SAN
RAFAEL DRIVE/FRANCIS DRIVE, 0-5 ZONE (IL) ,
SECTION 2 .
WHEREAS the City has received an application by Myron Bayless for
a Planned Development District and a Tentative Tract Map for 64
single family residential lots located on Avenida Caballeros
between San Rafael Drive/Francis Drive (the Project) ; and
WHEREAS the Planning Commission considered the Project at a duly
noticed public hearing held on November 13, 1991; and
WHEREAS the City Council held a duly noticed public hearing on
December 4 , 1991; and
WHEREAS the City Council has reviewed all evidence provided at the
hearing including the staff report dated December 4 , 1991, and all
other written and oral testimony, and finds the Project subject to
the conditions contained herein consistent with the requirements of
the ordinances of the City and with State law.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of
Palm Springs, California, after considering the evidence provided
at the hearing does hereby approve the preliminary Planned
Development District and Tentative Tract Map for property
hereinabove described in accordance with the following findings and
subject to the following conditions:
Section 1. The City Council finds:
a. That the Planned Development District and Tentative Tract Map
for 64 single family residential lots is consistent with
existing General Plan land use plan and policies.
b. That the Project is consistent with the proposed draft General
Plan text on file with the State of California Office of
Planning and Research (OPR) and there is a reasonable
probability that it will be consistent with the revised
general plan when adopted in that the project is consistent
with the overall density and land use character of the General
Plan which allows for low density residential uses in this
area.
C. That there is little or no probability the project will be
_ detrimental to or interfere with the future adopted General
Plan if the project is ultimately inconsistent with that plan.
' If a lower or higher intensity of development is adopted, the
project would probably not be detrimental to the plan.
d. That the 20. 37 acre site is adequate in size and configuration
to accommodate the proposed 64 single family residential lots
and complies with all property development standards
established for the planned development district.

e. That the proposed 64 single family residential lots applied
for under a planned development district and tentative tract
map applications at the location set forth in the application
is property authorized by local and State law.
f. That the site is loceated on Avenida Caballeros/San Ra£aal
Drive/Francis Drive which are adequate in size to accommodate
the quantity of traffic; anticipated by the proposed _
subdivision.
g. That an environmental assessment has been completed and that
a Negative Declaration with mitigation measures will be filed
in accordance with local and State laws.
Section 2 . The Project is approved subject to the following
conditions; all of which are to be satisfied prior
to issuance of a certificate of occupancy unless
otherwise specified:
a. That the Development Committee Conditions dated November 13 ,
1991, shall be met.

b. That the proposed development of the premises shall conform to
all applicable regulations of the Palm Springs Zoning
ordinance, Municipal Code, or any other City codes,
ordinances, and resolutions which supplement the zoning
district regulations.
C. That final landscaping, irrigation, exterior lighting, and
fencing plans shall be submitted for approval by the ]Planning
Commission prior to issuance of a building permit. Landscape
plans shall be approved by the Riverside County Agricultural
Commissioner's Office prior to submittal.
d. That pursuant to Fish and dame Code Section 711.4, a filing
fee of $25.00 is required. This project has a de minimis
impact on fish and wildlife, and a Certificate of Fee
Exemption shall be completed by the City and two copies filed
with the County Clerk. This application shall not be final
until such fee is paid and the Certificate of Fee Exemption is
filed. Fee shall be in the form of a money order or cashier's
check payable to Riverside County.
e. That final development plans shall be submitted in accordance
with Section 9403 . 00 of the Zoning Ordinance. Final
development plans shall include site plans, ]building
elevations, floor plans, roof plans, grading plans, landscape
plans, irrigation plans, exterior lighting plans, sign
program, mitigation monitoring program, site cross sections,
property development standards, and other such documents as
required by the Planning Commission. Final development plans
shall be submitted within two (2) years of the City Council
approval of the preliminary planned development district.
f. That the covenants, conditions and restrictions shall be
submitted to the City for approval.
g. That a homeowner's association shall be established to provide
for maintenance of all common areas including all improvements
within the public right.-of-way.
h. That perimeter walls shall maintain the corner cutback area as
required in Section 9302 . 00 of the Zoning Ordinance.

i. That details on all proposed walls shall be submitted for
approval with the final development plans.
j . That mitigation measures of the environmental assessment shall
be included as conditions of approval.
k. That the entry gate shall be redesigned to accommodate a turn
' around area outside the gates, a minimum of 40 feet back from
the island nose.
1. That the minimum front yard setback shall be 20 feet except in
the instance of side entry garages in which case the minimum
front yard setbacks shall be 15 feet.
M. That minimum setbacks shall be as per the siting plan approved
' by the City Council. For future additions, minimum setbacks
shall be made as follows: Front: 20 feet except in the
instance of side entry garages, in which case the minimum
front yard setbacks shall be 15 feet; Side: 10% of lot
width; Rear: 15 feet.
n. That the streets be redesigned as indicated on the revised
site plan presented at the November 13 , 1991, Planning
Commission meeting subject to the median island being
increased in width.
o. That the layout of the common area shall be restudied with the
final development plans.
P. That the landscape shall be restudied with the final
development plans.
