HomeMy WebLinkAbout17677 - RESOLUTIONS - 11/6/1991 RESOLUTION NO. 17677 •� OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING TENTATIVE TRACT MAP 26871 FOR ELEVEN (11) SINGLE-FAMILY LOTS ON PASEO EL MIRADOR/PASEO LE ANZA, 1'.- 1-AL ZONE, SECTION 11. WHEREAS the City has received an application by Steve Nichols for Frank Culver Nichols for a tentative tract map for eleven single- family lots on Paseo el Mirador/Paseo de Anza; and WHEREAS the Planning Commission considered the Project at a duly noticed public hearing held on September 25, 1991; and WHEREAS the Planning Commission recommended approval with conditions as outlined in its Resolution N. 4156; and WHEREAS the City Council held a duly noticed public hearing on October 16, 1991, on said project; and WHEREAS the City Council has reviewed all evidence provided at the hearing including the staff report dated October 16, 1991, and all other written and oral testimony, and find the Project, subject to the conditions contained herein consistent with the requirements of the ordinances of the City and with State law. NOW THEREFORE BE IT RESOLVED that the City Council of the City of Palm Springs, California, after considering the evidence provided at the hearing does hereby approve the Tentative Tract Map for property hereinabove described in accordance with the following -� findings and subject to the following conditions: SECTION 1. The City Council finds: a. That the subdivision of the subject 8. 22 acres into eleven (11) lot is consistent with existing General Plan land use plan and policies. b. That the project is consistent with the proposed draft General Plan text on file with the State of California Office of Planning and Research (OPR) and there is a reasonable probability that it will be consistent with the overall density and land use character of the General Plan which allows for medium density residential in this area. C. That there is little or no probability the project will be detrimental to or interfere with the future adopted General Plan if the project is ultimately inconsistent with that plan. If a lower or higher intensity of development is adopted, the project would probably note be detrimental to the plan. d. That the 8.22 acre site is adequate in size and configuration to accommodate the proposed eleven (11) parcel single family subdivision and complies with all property development standards. e. That the proposed subdivision applied for under a tentative tract map application at the location set forth in the application is properly authorized by local and State law. Res. No. 17677 Page 2 f. That the site is located on Paseo el Mirador and Paseo de Anza which are adequate in Size to accommodate the quantity of traffic anticipated by the proposed subdivision. 1?J . Th..at an environments assessment ', -is b(en completed and that a mitigated Negative Declaration of environmental impact will be filed in accordance with local and State law. h. That adequate access has been provided to the adjacent seven (7) acre tract. i. That a need for a street safety light has not been demonstrated. SECTION 2 . The Project is approved subject to the following conditions which are to be satisfied prior to , issuance of certificate of occupancy unless otherwise specified: a. That all Development Committee conditions dated September 25, 1991, shall be met. b. That Condition #29 of the Development Committee conditions dated September 25, 1991, requiring a 16,, 000 lumen high pressure sodium vapor safety street light shall be deleted. C. The proposed development; of the premises shall conform to all applicable regulations of the Palm Springs Zoning Ordinance, Municipal Code, or any other City codes, ordinances and resolutions which supplement the zoning district regulations. d. That the proposed street name shall be submitted to the Building Department for approval. e. That codes, covenants and restrictions be submitted for City approval. f. That the thirty foot easement be labeled "Lot C" for dedication purposes on the Final map. "Lot C" shall be revised as indicated on Exhibit A. The applicant shall make an irrevocable offer to dedicate Lot C on the final map. The City Council shall not accept dedication of :Lot C until such time that the adjoining property owner to the north develops said property. At that time the City may accept dedication and the improvements shall be constructed by the adjacent property owner to the specifications outlined by the City Engineer. An easement over Lot C shall also be granted to the , adjacent property owner to the north for the purpose of access to the property until such time as development occurs.
