OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, APPROVING A SUMMARY VACATION AND y
ABANDONMENT OF THE RIGHT-OF-WAY FOR A LIMITED
PORTION OF NORTH PALM CANYON DRIVE BETWEEN TAHQUITZ
CANYON WAY AND ANDREAS ROAD LOCATED WITHIN SECTION

WHEREAS the City Council is authorized by the Public Streets, Highways,
and Service Easements Vacation Law, Part 3, Chapter 4 to vacate and `
close to public use streets or parts of streets within the limits of
the City; and
WHEREAS the necessity of this street vacation and abandonment action
has been caused by the relocation of State Highway 111 from Palm Canyon
Drive to an alternate route within the City; and
WHEREAS the subject right-of-way and public use thereto have been
superseded by the relocation of State Highway III ; and
WHEREAS the subject vacation will not cut off access to any property
which prior to relocation adjoined) the street or highway; and
WHEREAS the subject vacation will not terminate any public service '
easements; and
WHEREAS the subject right-of-way is excess right--of-way and is not
required for street or highway purposes. ;
WHEREAS the Planning Commission at its October 9, 1991 , meeting found
that the vacation of the subject right-of-way is consistent with the
existing General Plan and draft General Plan.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Palm
Springs does hereby vacate the subject right-of-way described herein
as follows:
SECTION 1 . The City Council finds:
a. That the summary street vacation is consistent with the existing
General Plan land use plan , circulation plan, and policies. -
b. That the project is consistent with the proposed draft General Plan
text on file with the State of California Office of Planning and '
Research (OPR) and there is reasonable probability that it will
be consistent with the overall density and land use character of
the General Plan which allows for industrial uses in this area.
c. That there is little or no probability the project will be detrimental
to or interfere with the Future adopted General Plan, if the project
is ultimately inconsistent with that plan. If a lower or higher
intensity of development is adopted, the project would probably
not be detrimental to the plan. r
d. That this summary street vacation is categorically exempt under
CEQA.
e. That this street vacation and abandonment action is necessary due
to the relocation of State Highway III from Palm Canyon Drive to
an alternate route within the City.

SECTION 2. The summary vacation is approved subject to the following
conditions:
a. That the City Council does hereby vacate all of the City' s right,
title, and interest in that certain right-of-way dedicated for
property described herein and as described in Exhibit "A" and shown
on Exhibit "B" attached hereto and made a part hereof, a street
within the City of Palm Springs, County of Riverside, and State
of California.
' b. That the City reserves therefrom an easement for a public sidewalk
over and/or across the portion of right-of-way to be vacated, and,
in addition, excepts from said vacation all existing utility easements
of record. The legal description of such sidewalks and such utility
easements shall be determined by the City Engineer.
• c. That the right-of-way shall be vacated upon recordation of the
resolution and continue with existing.
+ d. That the City Clerk is directed to cause a certified copy of this
resolution, attested to by the City Clerk under the seal of the
City, to be recorded in the office of the County Recorder of Riverside
County, The City Clerk is further directed to transmit a certified
copy of this resolution to the County Surveyor of Riverside County.

THENCE Northeasterly along said curve through a central angle of
89 °58 ' 25" and an arc distance of 45. 55 feet to a point on a line
that lies 49 . 00 feet West and parallel with the centerline of North
Palm Canyon Drive;
THENCE along said line North 0"08 ' 00" West, a distance of 134 . 87
feet;
THENCE North 9 ° 47 ' 34" East, a distance of 52 . 21 feet to a point on
a line that lies 40 . 00 feet west and parallel with the centerline
of North Palm Canyon Drive;
