HomeMy WebLinkAbout17669 - RESOLUTIONS - 10/16/1991 RESOLUTION NO. 17669 ' OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, SETTING TIME AND PLACE FOR PUBLIC HEARING ON NECESSITY TO ORDER ACQUISITION BY EMINENT DOMAIN PROCEEDINGS. WHEREAS, the City of Palm Springs has been actively engaged in the acquisi- tion of certain lands for the construction and installation of street improvements consisting of curbs, gutter, and new paving for Assessment District 157 for the Ramon Road/Avenida Evelita area at various locations in Section 19, 11, and 14; and WHEREAS, it is necessary that certain land acquisitions be made in order to start construction as scheduled in January of 1992; and WHEREAS, at this time the City is desirous of setting a time and place for public hearing on the necessity to acquire the needed land not yet acquired for the said project. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs, California, as follows: Section 1. That the above citations are all true and correct. Section 2. That certain land acquisition necessary for the accomplishment of the AD 157 street improvements in the Ramon Road/Avenida Evelita Area is described in Exhibit "A" and shown on the map attached hereto and made a part hereof. Section 3. That notice is hereby given that on Wednesday, November 20, -� 1991, at the hour of 7:30 p.m. in the City Council Chambers at 3200 Tahquitz Canyon Way, Palm Springs, any and all persons whose land is to be acquired will have an opportunity to appear 1 and be heard on the matter of the necessity to exercise the right of eminent domain to acquire land necessary for the pro- posed construction of street improvements in Assessment District 157, the Ramon Road/Avenida Evelita area. All persons objecting to the public interest and necessity for the project and the determination as to whether or not the project is planned and/or located in a manner which will be most compat- ible with the greatest public good and the necessity for the property to be acquired should be present at said time and place if they wish to be heard pursuant to Sections 1245.235 of the Code of Civil Procedure. Section 4. Staff is hereby directed to notice the property owners con- cerning adoption of the Resolution of Necessity as required by code of civil procedure, Sections 1240.030 and 1245.235.
