HomeMy WebLinkAbout17666 - RESOLUTIONS - 10/16/1991 RESOLUTION NO. 17666 ` OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, RECOMMENDING TO RIVERSIDE COUNTY DENIAL OF CONDITIONAL USE PERMIT 03151 AND VARIANCE 1587 TO ALLOW THE CONSTRUCTION OF AN AUTO/TRUCK/CONVENIENCE MART AND RESTAURANT LOCATED SOUTH OF I-10, NORTH OF GARNET AVENUE AND WEST OF INDIAN CANYON DRIVE, SECTION 22 , SPHERE OF INFLUENCE. WHEREAS the City has received a copy of a Conditional Use Permit to ` allow the construction of an auto/truck/convenience mart and restaurant within an unincorporated portion of Riverside County and within the City's Sphere of Influence; and WHEREAS Riverside County Planning Department has transmitted said application to the City of Palm Springs for review and comment; and WHEREAS the Planning Commission considered the project at a duly noticed public meeting held on September 25, 1991; and WHEREAS the Planning Commission is evaluating land use intensities and land use distribution within the area which is part of the ' City-wide General Plan update study and annexation study;and WHEREAS the Planning Commission recommended denial of the request as outlined in its Resolution No. 4163 citing concerns of inconsistencies with the tourist activities, goals and policies for the City. Furthermore, the Planning Commission voiced concerns regarding the image impact this project would bring being that it is at the entryway to the City, and that there is a probability that the project may be detrimental to or may interfere with the proposed General Plan; and WHEREAS the Planning Commission recommended that an air quality study (per Air Quality Management District guidelines) and a traffic study be prepared in order to identify and mitigate potential environmental problems; and WHEREAS the City Council held a duly noticed public meeting on October 16, 1991, on said project; and WHEREAS the City Council has reviewed all evidence provided at the meeting including the staff report dated October 16, 1991, and all other written and oral testimony and finds the Project inconsistent with the policies of the City of Palm Springs as noted by the Planning Commission and described above. NOW THEREFORE BE IT RESOLVED that the City Council of the City of Palm Springs, California, does hereby recommend denial to the Riverside County Planning Department, East Area Planning Council and Board of Supervisors of the request by Pilot Oil Corporation/Ten Indian Partnership for Conditional Use Permit #3151 and Variance 1587 to allow the construction of an auto/truck/convenience mart and restaurant for property hereinabove described. SECTION 1. The City Council finds: ' a. That the City of Palm Springs is updating its General Plan, Res. No. 17666 Page 2 for which an extension of time has been granted by the State Office of Planning and Research (OPR) which will include the City's Sphere of Influence in which this project is located. b. That there is reasonable probability that the project will not be consistent with the revised General Plan when adopted. C. That the proposed Highway Commercial designation is intended to meet the needs of the recreational traveler and the local commuter rather than those of the intra-regional transportation industry. d. That a full Environmental Impact Report (EIR) should be prepared for this project with emphasis on traffic circulation and air quality. ADOPTED this 16th day of _QrtaLr __, 1991,.
