HomeMy WebLinkAbout17665 - RESOLUTIONS - 10/16/1991 RESOLUTION NO. 17665 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING TENTATIVE PARCEL MAP 26948 CREATING ONE PARCEL AT 200 S. SUNRISE WAY, R-2 ZONE, SECTION 13 . WHEREAS the City has received an ,application by Marriott Brighton Gardens/ASL Consultants, Inc. for a tentative parcel map creating one parcel at 200 S. Sunrise Way (the Project) ; and WHEREAS the Planning Commission considered the Project at a duly noticed public hearing held on September 25, 1991; and WHEREAS the Planning Commission recommended approval with , conditions as outlined in its Resolution No. 4157 ; and WHEREAS the City Council held a duly noticed public hearing on October 16 , 1991, on said project; and WHEREAS the City Council has reviewed all evidence provided at the hearing including the staff report: dated October 16, 1991, and all other written and oral testimony, and find the Project, subject to the conditions contained herein consistent with the requirements of the ordinances of the City and with State law. NOW TIIEREFORE BE IT RESOLVED that the City Council. of the City of ' Palm Springs, California, after considering the evidence provided at the hearing does hereby approve the Tentative Parcel Map for property hereinabove described in accordance with the following findings and subject to the following conditions: SECTION 1 . The City Council finds: a. That the subdivision of the subject 4 . 2 acres into one parcel for the elderly board and care facility is consistent with existing General Plan land use plan and policies. b. That the project is consistent with the proposed draft General Plan text on file with the State of California Office of Planning and Research (OPR) and there is a reasonable probability that it will be consistent with the overall density and land use character of the General Plan which allows for medium density residential in this, area. C. That there is little or no probability the ;project will be detrimental to or interfere with the future adopted General Plan if the project is ultimately inconsistent with that: plan. If a lower or higher intensity of development is adopted, the project would probably not be detrimental to the plan. d. That the 4 . 2 acre site its adequate in size and configuration to accommodate the proposed elderly board and care facility and complies with all property development standards. e. That the proposed subdivision applied for under a tentative parcel map application at the location set forth :in the application is properly authorized by local and State law. Res. No. 176.65....... ,. Page 2 f. That the site is located on Sunrise Way and Baristo Road which are adequate in size to accommodate the quantity of traffic anticipated by the proposed subdivision. g. That an environmental assessment has been completed and that a mitigated Negative Declaration of environmental impact will be filed in accordance with local and State law. SECTION 2 . The Project is approved subject to the following condition; which is to be satisfied prior to issuance of certificate of occupancy unless otherwise specified: a. That all Development Committee conditions dated September 25, 1991, shall be met. ADOPTED this 16th day of October 1991.
