HomeMy WebLinkAbout17644 - RESOLUTIONS - 9/18/1991 RESOLUTION NO. 17644 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING TPM 27139 TO RE-SUBDIVIDE TWO (2) LOTS LOCATED AT 1800 DESERT PARK AVENUE, R-1-C ZONE, SECTION 1. WHEREAS the City has received an application by Mr. Dominick Mercante to re-subdivide a . 56 acre parcel into two (2) lots; and WHEREAS the Planning Commission considered the project at a duly noticed public hearing held on August 28, 1991; and WHEREAS the Planning Commission recommended approval with conditions as outlined in its Resolution 4153 ; and r WHEREAS the City Council held a duly noticed public hearing on September 18 , 1991, on said project; and WHEREAS the City Council has reviewed all evidence provided at the hearing including the staff report dated August 28 , 1991, and all other written and oral testimony and find the Project, subject to the conditions contained herein consistent with the requirements of the ordinances of the City and with State Law. NOW THEREFORE BE IT RESOLVED that the City Council of the City of Palm Springs, California, after considering the evidence provided at the hearing does hereby approve Tentative Parcel Map 27139 for property hereinabove described in accordance with the following findings and subject to the following conditions: SECTION 1 . The City Council finds : a. That this parcel subdivision is consistent with the existing General Plan land use plan and policies which permit this type of land subdivision. b. That this parcel subdivision is consistent with the proposed draft General Plan text on file with the State of California Office of Planning and Research (OPR) and there is a reasonable probability that it will be consistent with the revised General Plan when adopted in that the project is consistent with the overall density and land use character of the General Plan which allows land subdivi.:;i_ons in this general area . C. That there is little or no probability the project will be detrimental to or interfere with the future adopted General Plan. If a lower or higher intensity of development is adopted, the project would probably not be detrimental to the plan. d. That the subject property is located within the Desert Park Estates No. 1 subdivision and the proposed lot configuration is consistent with the surrounding properties. e. That the proposed lot configuration is exactly the same as previously subdivided under the Desert Park Estates No. 1 map. f. That the proposed lots comply with all development standards prescribed by the R-1-C Zone. g. That the project i.s categorically exempt from CEQA guidelines being that it is a minor land subdivision. SECTION 2 . The project is approved subject to the following conditions; all of which are to be satisfied prior to issuance of certificate of occupancy unless otherwise specified: e)" R17644 Page 2 I a.
