OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, APPROVING TPH1 26943 TO
SUBDIVIDE A 13 . 288 ACRE TRACT FOR A 140 UNIT
APARTMENT COMPLEX ON SU14RISE WAY NORTH OF SAN
RAPHAEL DRIVE, PD-116, SECTION 35 .
WHEREAS the City has received an application by Coachella Valley '
Housing Coalition to subdivide a 13 . 288 acre tract for a 140 unit
apartment complex (the Project) ; and
WHEREAS the Planning Commission considered the Project at a. duly
noticed public hearing held on July 24 , 1991; and
WHEREAS the Planning Commission recommended approval with
conditions as outlined in its Resolution No. 4148 ; and
WHEREAS the City Council held a duly noticed public hearing on
September 4 , 1991, on said project; and
WHEREAS the City Council has reviewed al.l. evidence provided at the
hearing including the staff report dated September 4 , 1991, and all
other written and oral testimony, and finds the Project, subject to ,
the conditions contained herein consistent with the requirements of
the ordinances of the City and with State law. '
NOW THEREFORE BE IT RESOLVED that the City Council of the City of
Palm Springs, California, after considering the evidence provided
at the hearing does hereby approve TentativeP�rcel Map 26943 for
property hereinabove described in accordance with the following '
findings and subject to the following conditions:
SECTION 1. The City Council finds:
a. That the subdivision of the 13 . 288 acre parcel out of a 45 .89
acre parcel is consistent with existing General Plan land use
plan and policies.
b. That the project is consistent with the proposed draft General
Plan text on file with the State of California Office of
Planning and Research (OPR) and there is a reasonable
probability that it will be consistent with the revised
General Plan when adopted in that the project is consistent
with the overall density and land use character of the General
Plan which allows for medium density residential uses in this
area.
C. That there is little or no probability the project will be ;
detrimental to or interfere with the future adopted General
Plan. If a lower or higher intensity of development is
adopted, the project would probably not be detrimental to the
plan.
d. That the site is adequate in size and shape (13 . 288 acres) to ,
accommodate the proposed subdivision and that the proposed
development is in conformance with the Planned Development
District originally approved on the property in 1980.

e. That the Tentative Parcel Map will not have a detrimental
effect upon the surrounding environment. Any possible impacts
i� have been mitigated through the conditions of approval.
f. That the site is served by Sunrise Way which is adequately
t designed to accommodate any traffic generated by this project.
g. That the site was purchased by the City to provide a range of
housing opportunities.
h. That the conditions imposed are necessary to protect the
public health, safety and general welfare of the community.
i. That Case 5 . 0144-PD-116A for a 140 unit apartment complex was
approved by City Council on April 17, 1991.
j . That the property was previously assessed under Case 5 . 0144-
PD-116 and a Notice of Determination was filed on December 5,
1980.
SECTION 2 . The Project is approved subject to the following
conditions; all of which are to be satisfied prior
to issuance of certificate of occupancy unless
other wise specified:
• a. That all Development Committee conditions dated July 24 , 1991,
be met.
b. That all mitigation measures of the environmental assessment
for Case 5. 0144-PD-116 be met.
C. That only that portion of TentativeParcel Map 26943 regarding
=� the proposed 140 unit apartment complex be approved.
