HomeMy WebLinkAbout17610 - RESOLUTIONS - 7/31/1991 RESOLUTION NO. 17'610_ OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, PROVIDING FOR AND GIVEN NOTICE OF A SPECIAL MUNICIPAL ELECTION CONSOLIDATED WITH THE GENERAL ELECTION TO BE HELD ON NOVEMBER 5, 1991, FOR THE PURPOSE OF SUBMITTING DO TEM QUALIFIED ELECTORS OF SAID CITY, APPROVAL OF AN ADVISORY MEASURE ON THE DEVELOPMENT OF A RACEWAY AND RELATED FACILITIES. WHEREAS, a major component of the economic vitality of the • city of Palm Springs relates to tourism and revenues derived from visitor attractions; and WHEREAS, the City' s General Plan recognizes the importance of tourism and commercial recreation facilities in the City to complement tourism, including an objective of Creating a City-wide "holiday" atmosphere] and WHEREAS, Guthrie Companies and Arciero and Sons, Inc. have proposed the development of a Palm Springs international Raceway, an automobile and motorcycle racing facility, and related uses, including a hotel, restaurant, corporate offices, racing museum and exhibit center, and driving schools and WHEREAS, such development is proposed for an area to be annexed to the City immediately south of Interstate 10, bounded generally by Southern Pacific Railway on the south, Gene Autry Trail on the east, and Indian Avenue on the west; and WHEREAS, the proposed project is large in scope, with a number of significant impacts on the City, financial, environmental and otherwise; and WHEREAS, California Elections Code Section 5353 permits the City to ;submit advisory measures to the voters; WHEREAS, City Council has determined that the scope of the project, its effects, and the public interest generated thereby, make it appropriate to submit to the voters of balm Springs an advisory measure, indicating the level of popular support for development of the area as a Raceway with related facilities; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PALM SPRINGS AS FOLLOWS; Section 1. That there shall be and there is hereby ordered a special advisory municipal election, J Resolution No. 17610 Page 2 to be consolidated with the general election to be held November 5, 1991, for the purpose of submitting to the qualified electors of said City, the following advisory measure, to wit: ADVISORY VOTE ONLY Raceway and Related Facilities Proposal Should the City Council support the development of a Raceway and Related Facilities in an area to be annexed to the City, generally described as the property south of Interstate 10, bounded by Indian Avenue on the west , Southern Pacific Railroad on the south, and Gene Autry Trail on the east? a Yes [ ] No Section-. The measure shall be designated on the ballot by a letter printed on the left margin of! the square containing a description of the measure, as provided by Section 10219 of the Elections Code. Pursuant to California Elections Code Section 5011, the City Clerk is directed to transmit a copy of the measure to the City Attorney, and the City Attorney is directed to prepare an impartial analysis of the measure, showing the effect of the measure on existing law, and the operation of the measure. Seeti The Hoard of Supervisors of the County of Riverside is hereby requested to consolidate the Special Municipal Election to be held in the City of: Palm Springs on November 51 2.991, with the General Election to be held on the , same date; and to issue to all officers of said County charged with duties pertaining to said General ]election instructions take any and all steps necessary for the holding of said consolidated election. section 5. The Registrar of Voters is hereby authorized to canvas the returns of said Special Municipal Election, and said election and said General Hection shall be held in all Resolution No. 17610 Page 3 respects as if they were only one election, and only one form of ballot shall be used. Section_. The City of Palm Springs shall reimburse the County of Riverside in full for such services rendered, upon presentation of a proper invoice to the City Clerk of the City.
